    Community Feedback and Final Recommendations: 8 Can't Wait Policy Initiatives

    The Office of Police Oversight (OPO) developed final recommendations to revise the Austin Police Department’s (APD) use-of-force policies. The policy areas covered in this report include restricting shooting at moving vehicles, exhausting all alternatives before using deadly force, de-escalation, duty to intervene, banning chokeholds and strangleholds, and warning before shooting. OPO’s final recommendations incorporated community feedback and compared APD’s current use-of-force policies to national best practices in policing.

    APD, with support from the City Manager's Office, will review OPO's final recommendations before incorporating them into the General Orders. APD will bring the changes to the General Orders to City Council for feedback before they are implemented, as instructed by City Council.

    Background

    In June 2020, City Council passed a series of resolutions aimed at restricting the use of force by law enforcement. As part of those resolutions, the City Manager directed the OPO to facilitate a rewrite of the Austin Police Department (APD) policy manual, known as the General Orders. The rewrite will cover all policies, including those surrounding issues like search and seizure, body-worn cameras, dashboard cameras, mental health response, discipline, bias, language, and courtesy.

    This report concludes OPO’s three-phase approach to facilitating the rewrite of APD’s General Orders related to six use-of-force policy topics. Read the preliminary recommendations here.

    Comentarios de la comunidad y recomendaciones finales: Iniciativas de políticas 8 Can't Wait

    La Oficina de Fiscalización de la Policía (OPO) creó recomendaciones finales para revisar las políticas de uso de fuerza del Departamento de Policía de Austin (APD). Las áreas de las políticas cubiertas en este reporte incluyen restringir disparar a vehículos en movimiento, agotar todas las alternativas antes de usar fuerza letal, desescalar, deber de intervenir, prohibir las llaves al cuello y las llaves estranguladoras y avisar antes de disparar. Las recomendaciones finales de la OPO incorporan las opiniones de la comunidad y comparan las políticas actuales de uso de fuerza de APD con las mejores prácticas nacionales sobre labor policial.

    APD, con el apoyo de la Oficina del Administrador Municipal, revisará las recomendaciones finales de la OPO antes de incorporarlas a las Órdenes Generales. APD traerá los cambios a las Órdenes Generales ante el Concejo Municipal para comentarios antes de ponerlos en práctica, según lo indicó el Concejo Municipal.

    Antecedentes

    En junio de 2020, el Concejo Municipal aprobó una serie de resoluciones dirigidas a restringir el uso de fuerza por parte de las fuerzas policiales. Como parte de esas resoluciones, el Administrador Municipal pidió a la OPO facilitar la nueva redacción del manual de políticas del Departamento de Policía de Austin (APD), conocido como Órdenes Generales. La redacción cubrirá todas las políticas, incluidas aquellas relacionas con asuntos como registro e incautaciones, cámaras corporales, cámaras instaladas en las patrullas, respuestas de salud mental, disciplina, prejuicios, lenguaje y cortesía.

    Este reporte concluye el método de tres fases de la OPO para facilitar la nueva redacción de las Órdenes Generales de APD relacionadas con seis temas de políticas de uso de fuerza.
