It is the policy of the Austin Police Department (APD) that video evidence in the Department's possession pertaining to critical incidents involving APD will be released to the public within 60 days of the incident(s), unless the Chief determines that a delay is needed to address investigative, prosecutorial, or privacy interests. APD’s policy definition of “critical incidents” includes a use of force resulting in serious bodily injury as defined by Section 1.07 of the Texas Penal Code.
On March 3, 2021, the APD notified the community that the video release of the critical incident that occurred on January 5, 2021, at 2500 Wickersham Lane would not occur during the initial 60-day timeframe due to City of Austin weather-related closures. The Chief has determined that an additional delay is needed to address investigative and prosecutorial interests. At this time, APD is planning to release this critical incident briefing video no later than May 4, 2021.
The Austin Police Department continues to work with various stakeholders to provide a clear and unbiased account of critical incidents to the community. The goal of this effort is to increase transparency and build trust through the release of community briefing videos.
