Indefinite suspension of Officer Bryan Black & appeals finding
Chief of Police Brian Manley determined that Officer Black’s actions violated Civil Service Commission Rule 10.03 and indefinitely suspended him from duty, effective March 24, 2020. Internal affairs investigation revealed that Officer Black was dishonest and attempted to conceal his full culpability in relation to the incidents being investigated.
Officer Bryan Black appealed the Order of Indefinite Suspension issued by Chief Brian Manley on March 24, 2020. This is a civil service disciplinary appeal taken pursuant to Chapter 143, Texas Local Gov’t Code (“TLGC”) (“Chapter 143”). This was timely appealed and this matter was heard by an independent hearing examiner (“IHE”), whose review authority is co-extensive with that of the civil service commission. The examiner found that the City of Austin Police Department did not prove all of the charged misconduct by a preponderance of the evidence and there was not just cause to indefinitely suspend Officer Black. The discipline will be converted to a forty-five (45) day suspension.
