The complainant alleges that his neighbor, an Austin police officer, has hit his and his wife's vehicle multiple times with the officer's personal vehicle. The complainant called the police to ask the officer to move his vehicle, the officer did not comply and acted in an intimidating way toward the complainant and his wife. OPO recommends this complaint receive a B classification.

Complaint: The complainant alleges Officer
lives next door to him and on two
different occasions has hit his vehicle with his vehicle. Complainant alleges Officer
also
backed into his wife's vehicle on one occasion and
Police came out and asked Officer
to move his vehicle because it was still touching his wife's vehicle. Complainant alleges
an hour later Officer
still had not moved his vehicle but later when he did move the vehicle.
he starred his wife down. Complainant alleges he feels officer
is harassing them and he
does not know what will happen next.
This notice of formal complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service Rules, and
Municipal Civil Service Rules.
Recommended Administrative Policies to Review (to include but not limited to):
900.3.2 ACTS BRINGING DISCREDIT UPON THE DEPARTMENT Since the conduct of
personnel both on-duty or off-duty may reflect directly upon the Department, employees must
conduct themselves at all times in a manner which does not bring reproach, discredit, or
embarrassment to the Department or to the City.
301.2 IMPARTIAL ATTITUDE AND COURTESY Employees shall provide equal and fair
protection of all rights under local, state, and federal law for all members of the community. Law
enforcement will be conducted in an impartial and equitable manner.
900.1.1 RESPONSIBILITY TO KNOW AND COMPLY The rules of conduct set forth in this
order do not serve as an all-inclusive list of requirements, limitations, or prohibitions on employee
conduct and activities; employees are required to know and comply with all Department policies,
procedures, and written directives.
Recommended Classification: The OPO is permitted to make a preliminary recommendation on
the classification of administrative cases.
The OPO recommends this complaint receive a B classification.
The City of Austin is committed to compliance with the American Disabilities Act. Reasonable modifications and equal access to
communications will be provided upon request.
