On 11/27/25, between 7:25 AM and 7:30 AM, at the Trinity Methodist Church parking lot at 44th
and Maybelle (northeast side), APD vehicle 2689 appeared to be doing nothing but stalking me - a
Straight Christian Man. When I started writing down the vehicle number for this complaint, APD
vehicle 2689 left.
Identify and reprimand the guilty officer so that he/she NEVER does that to me again anywhere.
This is the second such incident at the same place at about the same time of morning in the past
two weeks - 11/15/25, between 7:10 AM and 7:20 AM, APD vehicle 2693 was the other.
Therefore, as I warned within my report of the first incident, expect me to now call this out to
APD"s top brass and speak to it publicly, on record, on TV.
This alleged APD stalking behavior will NOT be tolerated.

My complaint is for the response time that it took for the officers to arrive at my apartment. I also
would like to input a complaint for the person that handled the initial call as well. The officers
that arrived on the scene were empathetic and helped alleviate some of my concerns so my
complaint isn"t against them. When I called to report what was going on I felt very much
dismissed from the very start after I explained what the situation was. And as the conversation
continued I could tell that the operator sounded very much put out with the whole interaction
after finding out that my complaint concerned my neighbor who has mental issue and frequently
calls the police. It"s understandable that the police has dealt with my neighbors several times but
that shouldn"t have anything to do with me giving them a call. I believe my call should have been
handled with more finesse and professionalism. My neighbor has just kicked in my door at close
to 6am in the morning waking me out of my sleep. And I was feeling fearful and confused and
instead of being treated like someone who needed compassion, I was instead treated as if I was
more of a nuance. This situation wasn"t handled with the seriousness that was needed. Because
the operator judged my call based on my neighbors previous actions I was pushed down on the
list as a lower priority which is unacceptable. The situation it self showed that he was escalating,
as well as showed that someone else life was at stake because of his actions. The fact that the
situation wasn"t taken serious is really devastating to me b/c this situation could have gone a
completely different way and it was not treated with the necessary correct steps that needed to
be done. Also I"m not sure why he wasn"t taken to a mental behavior center instead of the
hospital and was released shortly after. The case number is

Hello, this is
I am filing a formal complaint regarding misconduct by APD officers
on October 2, 2024 at
I was wrongfully detained, placed in
excessively tight handcuffs, publicly humiliated, and treated as a criminal without any probable
cause or questions asked.
Officers were on private property without permission. I was there lawfully, working security at
the request of my employer, and this location is also my lawful residence due to my housing
situation under the Violence Against Women Act protections.
My dogs were traumatized, impounded, injured, and microchipped without my consent, despite
my clear verbal and written objections. Items were seized, my vehicle was impounded, and I was
denied access to my phone and contacts.
The officers' actions caused:
Emotional trauma
Loss of income
Damage to my reputation as a Texas teacher
Financial hardship
Harm to my property and animals
The District Attorney dismissed and rejected the charges on October 30, 2024. Because this
matter is fully resolved and dismissed, I am formally requesting the immediate release and return
of all property taken from me, including:
My BB gun
My Smith & Wesson SD40VE .40 caliber handgun,
serial number HEP5962, along with
all magazines and ammunition seized
Any other items removed from my vehicle or person
I am requesting that these items be returned today, as there is no legal basis for them to continue
being held.

Clarification of My Legal Rights Under Texas Law
Under Texas law, and per well-established firearms statutes, an individual who has not been on
probation or under supervision for over five years has their firearm rights restored, including the
right to possess a firearm in their home or residence.
I have not been on any probation or supervision for over three decades.
This means:
1. My firearm rights were fully restored long ago.
2. My vehicle and the private property where I live constitute my home under Texas law.
3. I was legally allowed to possess both my BB gun and my personal firearm.
I have written documentation from both the property owner and property manager, confirming
that:
I am legally permitted to live on the property
I am legally permitted to work security on the property
I am legally residing there as my home
I assist with safety and help maintain peace on the premises
This makes my possession of a firearm fully lawful and protected by statute.
Background and Wrongful Detention
As stated previously, I was wrongfully detained on October 2nd.
Officers:
Entered private property without permission
Never asked questions or attempted communication
Immediately escalated the situation
Used excessively tight handcuffs
Prevented me from retrieving my phone from my vehicle
Impounded both my truck and my dogs
Microchipped my dogs against my explicit objection
Traumatized my animals
Forced me to pay nearly $500 to retrieve my vehicle
Forced me to pay over $230 to recover my dogs "unaltered," although they were still
microchipped
Embarrassed me in public and defamed my character
This incident was triggered by a case from over three decades ago, a case I did not commit and
one that I am currently pursuing relief on, similar to the Michael Morton wrongful conviction
situation. This decades-old injustice continues to affect my rights and how I was treated on
October 2nd.
Case Status
Again, the District Attorney dismissed the case on October 30, 2024.
There is no legal reason for my firearm or property to remain in custody.
I reserve all legal rights, including:

The right to file for damages
The right to pursue civil action

Tonight I went to Long Center for a concert. When we were leaving from the parking area there
were 2 woman officer. We were in 1 line with others. Officer on the left hand side made some
movement to call the vehicle which is in front of me to the left exit and I followed it. Because
police officer on duty gave a sign for that. Other vehicle left from that side, and other officer at the
right hand side ran towards me and yelled me as "1 line sir"

He found a cell phone on the 23rd of November. He called 311 that day to report the lost cell
phone. 311 gave him two options: to take it to the carrier or to take it to the police. He chose to
take it to the police. He called 311 back and was told that someone from APD would be in touch
with him in the next 7-14 business days with next steps. Someone did reach out to him at 8:00am
on Thanksgiving morning and told him to take it to the nearest police station.
He called the police station and spoke to someone who told him he could not drop it off at a police
station and would have to take it to evidence. He called the evidence department this morning
and was told he could not drop off evidence there and to take it to the nearest police station.
He went to the Austin Police North Substation. Officer Coleman came down the stairs into the
lobby and was rude and dismissive to another person in the lobby who wanted to file a police
report and then went to speak to the complainant. She proceeded to scold him for not turning in
the phone earlier. He explained that he followed all the steps given and jumped through hoops to
get the phone to the right person. The complainant stated he could tell that the officer did not
want him to be there. The officer continued to be rude to him about it taking a few days to turn it
in. He didn"t get a report number or anything, was walked to the exit and told to leave. He wants
to make sure the officer"s supervisor is aware of this officer"s behavior.

Two police officers in an unmarked car and not wearing uniform approached my home and, in an
attempt to gain
access to a neighboring yard, broke my locked gate to gain entry into my backyard.
They gave me an odd case number
that I can find no information on (when I called
it in, I was told it was not a real
case number) and I was denied repair of my fence without explanation other than police are not
liable if it was done
during an official act.
I feel like it infringed on my 4th amendment right and also scared everyone living in the home.
They could have just
asked if they could go into the backyard, but instead acted without care and destroyed my
property.
I have video evidence from ring and phone cameras. It was disgusting and disturbing.
Type of Damage: Gate was forcibly opened while locked, shaking the posts loose, damaging the
locking mechanism, and breaking the wood. See images below (renters added decking after the
incident to close openings). I have video recordings of them driving up in the unmarked car and
breaking the fence.

The complainant alleges:
He was in his room. His wife and son were on their back porch with the dogs. They heard two gun
shots and came inside. They called their neighbor and the complainant went outside with his
light. He believed that one of the neighbors two houses down was the one who shot the gun. He
has had ongoing issues with this neighbor, and he has been a nuisance in the neighborhood since
he moved in and has been scaring the neighbors. The neighbor two houses down pushed the
complainant and assaulted him. They called the police.
The officers came and began speaking to them. Officer with the badge number 10541 took their
statement about what happened. The complainant gave them his neighbor"s name and address.
The complainant"s son and neighbor also gave statements. About two weeks later, the
complainant got an email saying APD wasn"t going to do anything because they didn"t have the
name or the address of the suspect. Detective Holmes AP6858 told him the complainant needed
to file a report online or go in person to file the report because there were no bruises. The
detective was kind of short with the complainant over the phone. The complainant requested a
call back from the Detectives Supervisor- Sgt Martin and hasn"t heard back yet. The complainant
tried to file the report online, but it kicked them off and said they needed to call the police. The
police report says that the neighbor only pushed the complainant, but the neighbor hit him twice
and then pushed him. There were witnesses and APD didn"t talk to them. Cause number 25-

311 intervene. When I finally spoke with Detective Ramirez, his only comment was, "I cannot
force these employees to call me back."
also contacted him and was told that pawn shops were checked (though no details
were provided), and that neither of the two employees involved had returned his calls. He further
stated that he will be leaving the department in January and that the case will likely be
suspended.
Given the approximate value of the missing items, this matter clearly falls under grand theft, and I
am concerned about the lack of urgency. Specifically, I need clarity on whether the following
actions have been taken:
Has the detective personally visited local pawn shops?
Has he attempted to visit the residence of the former employee involved?
Has he contacted me to arrange a meeting with the current employee still on staff?
Has he had a thorough conversation with
to confirm details and rule out
misplacement?
Has he obtained proof of ownership from the customer?
Has he provided reasonable updates or explanations to either
or myself?
As I know many of these answers are likely "no," I am now reaching out to you directly. Please

that while walking home from work, he observed a firearm lying on the ground. He states that he
picked it up because it was unattended and he was unsure why it was there. According to the
complainant, as soon as he picked up the firearm, two police vehicles approached him at a high
rate of speed. He became frightened and dropped the firearm back onto the ground. The
complainant alleges that he was simply in the wrong place at the wrong time and that officers

24-2480038 and Medical Examiner case 24-05372. I am formally requesting a full review of the
handling and investigation of her death.
The Medical Examiner's investigative report contains several concerning procedural issues,
including:
The driver was allowed to wander freely around the scene prior to full scene control.
No field sobriety test or toxicology collection was performed at the scene.
The driver was permitted to leave the scene unaccompanied, reportedly to go to a hospital,
without police oversight.
Despite extensive traumatic injuries and unclear circumstances, the case was initially treated as
not involving foul play.
Given these issues, I respectfully request:
1. A formal review by Internal Affairs and/or the Office of Police Oversight regarding scene
handling and investigative procedures.
2. Access to all materials associated with the case, including body camera footage, officer notes,
911 call audio, witness statements, photographs, and any accident reconstruction.

On the date of 10/19/2024, I was unlawfully apprehended by APD officer (9098)
along with other officer whom both were on foot. As I was strolling the downtown area
proceeding from W. 6th street heading eastward, I decided to stop and have a seat in an
alley in between Red River and Trinity caused by excessive walking and fatigue and to
converse with acquaintances. Thereupon officers approached me immediately stating
"place your hands behind your back", without providing legitimate probable cause of the
crime I allegedly committed. Neither was my rights Miranda rights read to me pertaining
to offense which police officers are required to read suspects according to Tx Code of
Criminal Procedure at some point during one's detainment. In addition, I declare this
matter of incident to be discrimination based on the fact that there were a crowd of
others whom which were sitting in the same area prior to my arrival given that officers
had to walk past an entire group of people to even approach me. Perez attempted to
justify actions by stating he gave several warnings to leave location whereas I was not
within vicinity if this was so nor did I hear precaution otherwise I would have obviously
obeyed order. Resulting of this situation is what led to failure to identify and resisting
arrest (caused by illegal arrest, harassment, violation of rights and assault by officers.
Officers involved assaulted me all because I expressed the need to fight for my rights and
not comply with their blatant misconduct. Officer Perez swelled my jaw on the right side
by aggressively pressing my face against the wall during arrest and others slammed me to
the ground while choking me as I screamed and pleaded I could not breathe. Repeatedly I
requested for medical however was ignored and denied, then forced into patrol vehicle
with both of my feet restrained, an unlawful act. Upon booking I was then informed of
charges pending which were: 1) violation of city ordinance offence only punishable by
fine); 2) failure to identify; 3) resisting arrest(2x). I was also assaulted by officer
Perez#9098) along with other sheriffs upon booking.

On September 14th, 2025, I was a passenger in a vehicle when Austin Police Officer Badge #9919
unlawfully escalated a situation that had nothing to do with me. I was drinking, but I was not
driving, and there was no crime, no disturbance, and no legal reason for the officer to demand my
name or ID. Despite having no probable cause, he ordered both of us out of the car-forcing me to
stand outside without shoes-and then made me put my hands behind my back. He placed me in
the back of the police car with my hands cuffed backwards, causing immediate pain and damage
to my wrists. My wrists swelled so badly afterward that I couldn't even wear bracelets for weeks,
and now, in December, they still hurt. I continue to suffer emotional trauma from what he did. As
a former first responder from
, this officer's unjustifiable behavior has shaken
my trust in law enforcement entirely.
To make matters worse, the officer's misconduct continued when the lieutenant falsely accused
my husband of injuring my wrists-when it was Officer 9919 who caused the injury. My husband
merely touched my wrist because I told him it hurt. Despite that, the lieutenant had him arrested
while completely ignoring the real cause of my injury. The actions taken against both of us were
ridiculous, unjustified, and a violation of my constitutional rights in every possible way. I am
demanding a full investigation, interrogation of Officer 9919, review of body-camera footage,
disciplinary action up to removal, and compensation for the physical harm, emotional trauma,
and ongoing suffering caused by this officer's misconduct.

1. Prior Sustained Discipline (Relevant History)? In IA Case 2019-0710, Detective Holmes
received a sustained finding and Oral Reprimand for using a tobacco product while engaged in
official police business, in violation of APD Policy 946.2 (public record).
2. May 2023 - Alleged Failure to Properly Investigate Assault Harassment?
In May 2023, a female victim filed a complaint alleging that Detective Holmes closed her assault
and harassment case despite her submission of evidence of physical injury, recent major surgery,
and ongoing harassment. The case was closed citing "lack of evidence." This closure appears
inconsistent with APD policies requiring thorough investigation of reported crimes, particularly

3. February 28, 2025 - Alleged Abuse of Authority and Retaliation ?On or about February 28,
2025, an individual received a telephone call from a person claiming to be law enforcement who
stated that a felony arrest warrant was about to be issued and that the recipient would become a
felon. ?When the recipient went in person to an Austin Police Department facility to verify the
claimed warrant, on-duty personnel informed them that Detective Holmes is not a police officer
(indicating he lacks authority to issue or execute warrants in that manner) and that the call was
likely a scam, as no warrant existed.? The recipient believes the call originated from Detective
Holmes and was made in retaliation for a police report the recipient had previously filed against
his own ex-girlfriend regarding the theft of the recipient's bicycle.? If substantiated, using (or
appearing to use) official authority to intimidate or retaliate against a citizen for filing a
legitimate police report would constitute serious violations of APD policy and Texas state law,

like that should not be made. So, the detective ; Matthew Gil, who was assigned to the case for
investigation agreed to let us see the video. He stated before the video started that

walking back and forth across the street. Mind you, he didn't show us that part of the video. (I
know my son, no matter what, he had better sense than that).. Det. Gil practically rushed the
video and left us feeling some type of way. He had to re-do the police report several times. Stated
the driver had license when he didn't and other discrepancies. He didn't try to slow the video
down and blow up the second car's plates. I feel like he wasn't in our best interest at all. He and
his co-worker
gave me the impression that they weren't all in If you have a
position like that, I feel like you should have some compassion. They had to borrow the
laundromat's camera because the city has Springdale and MLK set up with a dummy camera.
Makes no sense at all. To top it all off, a year after
death, they put up a sidewalk.
(Ironic). So much more to say, this is a start. I'm so distraught, discouraged and disappointed
about how this whole case was handled. They need more training.

On 12/11/25, between 7:30 AM and 7:45 AM, at the Trinity Methodist Church parking lot at 44th
and Maybelle (northeast side), APD vehicle 9288 appeared to be doing nothing but stalking me - a
Straight Christian Man. When I started writing down the vehicle number for this complaint, while
standing on the public sidewalk, APD vehicle 9288 quickly drove right at me before pulling up
next to me, trying to intimidate me and make me move. I stood my ground, watching the APD
vehicle. The male police officer then asked me, "What"s up?" I did NOT respond. I simply stared
right back at him until he drove back to where he initially was in the parking lot. I kept looking
right at him until he finally, but too late, left a few minutes later. He did NOT appear to be
answering a call.
Identify and reprimand the guilty male officer so that he NE ER does that to me again anywhere.
This is the third such incident at the same place at about the same time of morning in the past 30
days - 11/15/25, between 7:10 am and 7:20 am, APD vehicle 2693 was the first and 11 27 25,
between 7:25 am and 7:30 am, APD vehicle 2689 was the second. Both of those incidents were
also documented with OPO.
I testified to the Public Safety Commission earlier this month that this alleged APD stalking
behavior will NOT be tolerated.

I am writing to formally request assistance and review regarding the handling of my burglary
case with the Austin Police Department.

Video Surveillance Evidence Not Preserved
According to
the apartment complex manager, he informed Detective Tavera
multiple times that:

When the detective eventually arrived,
stated that the elevator and building
footage had already been erased due to the delay.
indicated that the detective had
been advised earlier to come view the footage in person.
However, Detective Tavera later told me that he "thought" the videos were saved, which is
inconsistent with what the apartment manager states he clearly communicated.
As a result, potentially critical surveillance evidence appears to have been lost.
HEB Receipt Evidence - Urgent Concern
Additionally, a receipt from HEB was recovered from one of my stolen vehicles. This receipt
includes:
The store location
The date and exact time
The specific register used
Indication that a SNAP/EBT card (or similar assistance card) was used
This receipt may be one of the strongest investigative leads in the case, as it could potentially
identify the individuals involved.
Despite the urgency and the fact that retail surveillance footage is also subject to erasure,
Detective Tavera has not yet gone to HEB to view or secure the footage, nor has he followed up on
the SNAP/EBT information tied to the transaction.
I am very concerned this evidence may be lost as well if it is not addressed immediately.
Communication Issues
I have made numerous attempts to contact Detective Tavera via phone calls and text messages
over many days. Responses have been rare and delayed, leaving me without updates or clarity on
whether critical investigative steps are being taken.

Given the seriousness of this case, the amount of loss involved, and the ongoing risk of evidence

I am submitting this as a formal complaint regarding the conduct of several Austin Police
Department officers involved in my DWI investigation on [date]. Although I was ultimately
released at the scene and not transported or booked, the incident raises serious concerns about
training, accuracy, and adherence to APD procedures. The case was later dismissed.
During the stop:
I passed all standardized field sobriety tests.
I passed the breath test.
No odor of marijuana was noted.
I did not admit to using any substance.
No Drug Recognition Expert (DRE) evaluation was conducted.
No physiological indicators of impairment were documented.
A trainee officer made the primary impairment determination.
Despite the absence of evidence indicating impairment, I was detained for approximately 92
minutes. My vehicle was searched, and the detention appeared to be based solely on possession
of vape pens and the officer's subjective interpretation of my eyes. No standardized drug
impairment protocol was followed.
At the conclusion of the detention, the officer apologized for the situation and offered me a
courtesy ride, acknowledging that the arrest decision was not supported. I was released at the
scene without transport or booking. I am requesting that APD:
Review the body worn camera footage and the arrest report.
Evaluate whether proper procedures were followed.
Determine whether the trainee officer received appropriate supervision.
Document this complaint and advise me of the findings.

On 12/11 I was arrested. I was walking from down Cesar Chavez and was a few blocks from the
Terrazas library when I stopped to rest and set down my belongings for a moment. A security
guard across from the car lot close to the westbound bus stop told me I could not be there. Police
were called, and showed up in a very aggressive manner while I was walking away on the
sidewalk. The first police officer showed up alone and tried to grab me, but I didn"t know what
for. He could not grab me or get a grasp on me so they proceeded to use extra force and a taser
gun. Another unit arrived about 2 minutes later in a different vehicle and they both tased me at
the same time. I was handled very roughly, with tight handcuffs and bending and twisting my
wrists so forcefully that I received deep and open wounds on my wrists and arms from the
handcuffs, serious enough that I needed medical attention, wound care, and am on a course of
antibiotics to treat these injuries (photos are attached, taken today, one week after the incident).
During this incident I do not believe body cams were on but a dash cam was. The physical police
brutality lasted from the police officers who showed up to the intake to the correctional officers
that are in central booking twisting my wrists, left and right and tightening the handcuffs which
were never loosened. The resulting wound is still open.

Chief of Staff Henderson and members of the City Legal team are engaging in harassment and
creating a hostile work environment by pursuing investigations that are baseless. One such
investigation involved Assistant Chief Gaslin, Commander Egal, Lieutenant Pittman and Sergeant
Eads last year (all exonerated). This investigation was retalliation for not siding with Henderson,
Commander Cruz and City Attorneys Ally and Warren over two other officers on a seperate
investigation. If you do not agree with City Legal and Chief Henderson, they will use Internal
Affairs as a means of harassment to create a hostile work environment. An investigation needs to
take place for all those mentioned in order to restore trust.

hours over a weekend to move it. No one informed him about it, until a neighbor checked in to

He was in a small collision. He called 311 and they told them because it was a small incident, to go
ahead and exchange insurance information. The woman he was in the collision with believed that
the complainant"s information was false, so she called APD. Four hours later, APD showed up.
APD said they wouldn"t write a report, but took his information down to verify it, then gave back
his driver"s license and insurance information and said that he could leave. When he filed a claim
with his insurance this morning, they told him the other party"s insurance was incorrect. The
complainant is concerned that only his information was validated and not hers and feels he was
being discriminated against.

Leaving work from lakeline mall coming out at the intersection of rockstop blvd and ridgeline
blvd but there was a bad two car accident that was blocking the intersection.
I was going to try and make a U turn to go back into the mall i assumed traffic was being rerouted
like it usually is during a terrible car accident but the cop ran towards my car screaming and
shouting, I rolled my window down to understand him but he continued screaming at me i was
immediately overwhelmed trying to comprehend what was happening i told him my ID was in my
phone case which was in the passenger side of my car he continued screaming then he reached
into my car to try and open my door when my car wasn't in park yet and i was diagonal in the
middle of the road. He was extremely aggressive and i was scared and couldn't even process what
was happening. He then took my ID and left me in the car for over 40 minutes while he never
attended to the people in the car crash. During the whole time he never payed attention to the
people from the accident while the victims tried telling him multiple times one person in their
party was dizzy and not feeling good the ambulance was not called to the scene while both cars
where totaled and airbags deployed. i was extremely aggressive and im terrified to think about
what would have happened if he took me out of the car.

I was assaulted by my ex boyfriend on December 20th. He tackled me from behind, pinned my

no one will

Officers Kitt and Sanchez conducted a traffic stop of my vehicle in downtown Austin. From the
beginning of the encounter, Officer Kitt (Badge #9452) acted in an aggressive and unprofessional
manner, including striking the vehicle window with his flashlight and speaking to us in a hostile
tone. Two minors, ages 16 and 12, were present in the back seat. We were not initially informed
of the reason for the stop and were immediately questioned about weapons. After my boyfriend
disclosed possession of a legally registered firearm, he was handcuffed and placed in a patrol
vehicle. Officer Kitt later stated the stop was due to failure to signal and a non-functioning license
plate light, which we dispute, as the turn signal was used and the vehicle has not previously had
issues with the license plate light. The vehicle was searched multiple times while we were
repeatedly questioned about drugs and firearms, despite no illegal items being found. Officer
Sanchez questioned my 12-year-old brother about drugs in his backpack, which I believe was
inappropriate given his age. Despite multiple searches yielding no evidence, we were told there
was marijuana residue in the vehicle, which is not accurate.
Reason for Complaint:
Based on the totality of the encounter, I believe we were unfairly profiled and treated in an
intimidating and disrespectful manner, particularly by Officer Kitt. The conduct displayed did not
align with professional standards expected of Austin Police Department officers and caused me to
feel threatened rather than protected.

I am submitting this formal complaint regarding the conduct of Sergeant Knodel Badge# 7855]
on December 23rd, 2025 at
, during an incident
involving damage to my tow truck caused by a vehicle that was being operated under its own
power on my tow deck.
1. Summary of Incident
While my company was performing a lawful repossession, the vehicle owner entered the vehicle,
operated it under its own power, and attempted to drive off my tow truck. During this movement,
the vehicle struck and damaged my tow truck and equipment. I contacted police so the matter
could be properly documented as a collision, and so the required exchange of information-
including insurance information-could occur.
2. Officer Incorrectly Stated It Was "Not a Collision"
Sergeant Knodel Badge# 7855 stated that the event was "not a collision" and refused to classify it
as such. This statement was legally incorrect.
Under Texas Transportation Code § 550.022 (Collision Involving Damage to Vehicle), the duty to
stop and exchange information applies when:
"The operator of a vehicle [is] involved in a collision resulting only in damage to a vehicle that is
driven or attended by a person."
My tow truck was clearly attended by my employee, and the other vehicle was clearly operated
and under the driver's control. The movement of that vehicle caused direct damage to my
attended vehicle.

This meets all statutory elements of a collision, regardless of where it occurred or what
terminology the officer chose to use.
Courts have repeatedly held that the statutory duties after a collision depend on the facts of the
event, not on an officer's subjective description:
Mokuolu V. State, 2003 WL 21235555 (Tex. App.-Texarkana):
Duties attach when a vehicle is involved in an accident causing property damage.
Kacz V. State, 2009 WL 5155548 (Tex. App.-Houston [14th Dist.]):
§ 550.022 is triggered by any damage to an involved vehicle.
Reynolds V. State, 2024 WL 1096350 (Tex. App.-Tyler):
Reiterates the statutory language of "collision involving damage to a vehicle that is driven or
attended by a person."
Nowhere in Texas law does an officer have discretion to redefine what is or is not a collision when
the factual statutory elements are plainly met.
3. Sergeant Knodel Badge# 7855 Refused to Facilitate Required Insurance Exchange
After misclassifying the event, Sergeant Knodel Badge# 7855 refused to obtain or provide the
other operator's insurance information.
This directly contradicts Texas Transportation Code § 550.023, which requires:
The operator of a vehicle involved in an accident resulting in damage to a vehicle that is driven or
attended by a person shall:
(1) Give their name and address;
(2) Provide the registration number of their vehicle;
(3) Provide the name of their liability insurer;
(4) Show their driver's license if requested and available.
Because the event was legally a collision causing damage to my attended vehicle, the officer
should have ensured compliance with § 550.023 and documented the driver's insurance
information.
4. Officer Failed to Fulfill Statutory Duties to Investigate
Under Texas Transportation Code § 550.041, an officer who is notified of a motor vehicle collision
causing property damage may investigate regardless of where it occurred, including private
property.
Under Texas Transportation Code § 550.062, once an officer begins investigating a motor vehicle
collision, he must complete a written report if the damage is ? $1,000.

Alonzo V. State, 2008 WL 495164 (Tex. App.-Austin), held: Once dispatched to an accident, an
officer has a duty to determine whether the event constitutes a reportable collision, and if so,
must file a collision report.
Sergeant Knodel Badge# 7855 refused to acknowledge or evaluate the property damage, failed to
determine whether the damage exceeded the $1,000 reportable threshold, and instead
prematurely dismissed the event as "not a collision."
5. Statutory and procedural failures
Based on the statutes and case law above, Sergeant Knodel Badge# 7855: Incorrectly and
unlawfully refused to classify the event as a collision; Refused to enforce the duties under §
550.022 and § 550.023; Incorrectly treated a factual collision as a non-event; Failed to assist in
the required exchange of insurance information; Failed to follow the statutory framework
governing collisions on private property. These actions prevented proper documentation of the
incident, obstructed the lawful exchange of insurance information, and caused material harm to
my company as the victim of the collision.
6. Requested Actions
I respectfully request that the department: Conduct a full Internal Affairs investigation into
Sergeant Knodel Badge# 7855 actions; Determine why § 550.022 and § 550.023 were not
enforced; Provide retraining to the officer in the proper classification of collisions and statutory
duties after a collision; Provide a written response detailing investigative findings and corrective
actions. Provide me with the other drivers insurance information as required by law.

Austin Police Department Officer, in traffic, became unprofessional in the roadway, when driving
recklessly. That assaulted a professional. The officer continued, recklessly to cause a hostile work

I am absolutely furious about a complaint made against my son's father that turned into an arrest
warrant.

have been in a high conflict custody battle for their
baby. Early summer,
has threatened that if he doesn't sign over his parental rights, that he
would be going to jail on baseless claims of domestic and physical abuse. She has lied and
coached her daughter to file a complaint of sexual contact with her underage teenage daughter.
Williamson county sheriff completed their investigation and the DA refused to take the case due
to concerns of retaliation and coaching. (attached is the DA letter). She has filed multiple
baseless CPS complaints on my son and their baby which all have been closed or not taken
further than an initial intake. She has called in complaints to multiple law enforcement agencies
across Williamson County and Travis County (and recently Hays County) on the baseless claim
that he is stalking and harassing her or kidnapping their baby. (which he has sole custody of as a
result of their 3rd and final custody hearing on Oct 31)
This leads us to the incident on Oct 16 where
tried to talk to her while they were
on the road in Austin near Airport Blvd. He wanted to tell her about the order for a Writ of
Habeas Corpus that was granted by Judge Terrance Davis of Williamson County but due to her
suspicious behavior in the car with her phone, he decided not to continue communication. She
took this incident and decided to file an "impersonation of law enforcement officer" claim.
Somehow, this was processed WITHOUT EVER CONTACTING
and it then turned
into an arrest warrant.
His family had to come together and spend $10K on an attorney to get his bond and help fight this
BASELESS charge. As the attorney was reading the police report, we all were absolutely baffled at
the absurdity of the details. "He threw a badge in through her car window". A person
impersonating a law enforcement officer is going to throw his badge in through her car window??
She also stated there as an unopened package which was given to her by

had an Apple Watch which must be how he tracked her. YOU HAVE TO LINK AN APPLE WATCH
TO THE PERSON'S PHONE IN ORDER TO TRACK IT!!

next month to talk about this event.
Also, with an arrest warrant, my son (and even his friends) could have been in the car with him
and if he had gotten pulled over for something simple like not coming to a complete stop at an
intersection, he could have been arrested on the spot with my son witnessing that type of
traumatic event.
If a simple investigation was done a simple call to

I am 67 years old and have been assaulted twice by the same person during the last 2 months. I
filed a police report each time. No action was taken on either.
The first police report (#2025-9028253) was accepted by APD. But no action was taken. And no
communication with me was attempted.
The second police report (temporary reference #2585827) was rejected with the notation that I
should have called 3-1-1 at the time of the incident instead of filing a formal report.
After the second non-action, I complained to Chief Lisa Davis. But she also did nothing.
I had thought that one of the top priorities of APD is to protect the elderly. That appears to have
been a misapprehension on my part.

On 11/27/25, between 7:25 AM and 7:30 AM, at the Trinity Methodist Church parking lot at 44th
and Maybelle (northeast side), APD vehicle 2689 appeared to be doing nothing but stalking me - a
Straight Christian Man. When I started writing down the vehicle number for this complaint, APD
vehicle 2689 left.
Identify and reprimand the guilty officer so that he/she NEVER does that to me again anywhere.
This is the second such incident at the same place at about the same time of morning in the past
two weeks - 11/15/25, between 7:10 AM and 7:20 AM, APD vehicle 2693 was the other.
Therefore, as I warned within my report of the first incident, expect me to now call this out to
APD"s top brass and speak to it publicly, on record, on TV.
This alleged APD stalking behavior will NOT be tolerated.

My complaint is for the response time that it took for the officers to arrive at my apartment. I also
would like to input a complaint for the person that handled the initial call as well. The officers
that arrived on the scene were empathetic and helped alleviate some of my concerns so my
complaint isn"t against them. When I called to report what was going on I felt very much
dismissed from the very start after I explained what the situation was. And as the conversation
continued I could tell that the operator sounded very much put out with the whole interaction
after finding out that my complaint concerned my neighbor who has mental issue and frequently
calls the police. It"s understandable that the police has dealt with my neighbors several times but
that shouldn"t have anything to do with me giving them a call. I believe my call should have been
handled with more finesse and professionalism. My neighbor has just kicked in my door at close
to 6am in the morning waking me out of my sleep. And I was feeling fearful and confused and
instead of being treated like someone who needed compassion, I was instead treated as if I was
more of a nuance. This situation wasn"t handled with the seriousness that was needed. Because
the operator judged my call based on my neighbors previous actions I was pushed down on the
list as a lower priority which is unacceptable. The situation it self showed that he was escalating,
as well as showed that someone else life was at stake because of his actions. The fact that the
situation wasn"t taken serious is really devastating to me b/c this situation could have gone a
completely different way and it was not treated with the necessary correct steps that needed to
be done. Also I"m not sure why he wasn"t taken to a mental behavior center instead of the
hospital and was released shortly after. The case number is

Officers were on private property without permission. I was there lawfully, working security at
the request of my employer, and this location is also my lawful residence due to my housing
situation under the Violence Against Women Act protections.
My dogs were traumatized, impounded, injured, and microchipped without my consent, despite
my clear verbal and written objections. Items were seized, my vehicle was impounded, and I was
denied access to my phone and contacts.
The officers' actions caused:
Emotional trauma
Loss of income
Damage to my reputation as a Texas teacher
Financial hardship
Harm to my property and animals
The District Attorney dismissed and rejected the charges on October 30, 2024. Because this
matter is fully resolved and dismissed, I am formally requesting the immediate release and return
of all property taken from me, including:

Clarification of My Legal Rights Under Texas Law
Under Texas law, and per well-established firearms statutes, an individual who has not been on
probation or under supervision for over five years has their firearm rights restored, including the
right to possess a firearm in their home or residence.
I have not been on any probation or supervision for over three decades.
This means:
1. My firearm rights were fully restored long ago.
2. My vehicle and the private property where I live constitute my home under Texas law.
3. I was legally allowed to possess both my BB gun and my personal firearm.
I have written documentation from both the property owner and property manager, confirming
that:
I am legally permitted to live on the property
I am legally permitted to work security on the property
I am legally residing there as my home
I assist with safety and help maintain peace on the premises
This makes my possession of a firearm fully lawful and protected by statute.
Background and Wrongful Detention
As stated previously, I was wrongfully detained on October 2nd.
Officers:
Entered private property without permission
Never asked questions or attempted communication
Immediately escalated the situation
Used excessively tight handcuffs
Prevented me from retrieving my phone from my vehicle
Impounded both my truck and my dogs
Microchipped my dogs against my explicit objection
Traumatized my animals
Forced me to pay nearly $500 to retrieve my vehicle
Forced me to pay over $230 to recover my dogs "unaltered," although they were still
microchipped
Embarrassed me in public and defamed my character
This incident was triggered by a case from over three decades ago, a case I did not commit and
one that I am currently pursuing relief on, similar to the Michael Morton wrongful conviction
situation. This decades-old injustice continues to affect my rights and how I was treated on
October 2nd.
Case Status
Again, the District Attorney dismissed the case on October 30, 2024.
There is no legal reason for my firearm or property to remain in custody.

He found a cell phone on the 23rd of November. He called 311 that day to report the lost cell
phone. 311 gave him two options: to take it to the carrier or to take it to the police. He chose to
take it to the police. He called 311 back and was told that someone from APD would be in touch
with him in the next 7-14 business days with next steps. Someone did reach out to him at 8:00am
on Thanksgiving morning and told him to take it to the nearest police station.
He called the police station and spoke to someone who told him he could not drop it off at a police
station and would have to take it to evidence. He called the evidence department this morning
and was told he could not drop off evidence there and to take it to the nearest police station.
He went to the Austin Police North Substation. Officer Coleman came down the stairs into the
lobby and was rude and dismissive to another person in the lobby who wanted to file a police
report and then went to speak to the complainant. She proceeded to scold him for not turning in
the phone earlier. He explained that he followed all the steps given and jumped through hoops to
get the phone to the right person. The complainant stated he could tell that the officer did not
want him to be there. The officer continued to be rude to him about it taking a few days to turn it
in. He didn"t get a report number or anything, was walked to the exit and told to leave. He wants
to make sure the officer"s supervisor is aware of this officer"s behavior.

Two police officers in an unmarked car and not wearing uniform approached my home and, in an

He was in his room. His wife and son were on their back porch with the dogs. They heard two gun
shots and came inside. They called their neighbor and the complainant went outside with his
light. He believed that one of the neighbors two houses down was the one who shot the gun. He
has had ongoing issues with this neighbor, and he has been a nuisance in the neighborhood since
he moved in and has been scaring the neighbors. The neighbor two houses down pushed the
complainant and assaulted him. They called the police.
The officers came and began speaking to them. Officer with the badge number 10541 took their
statement about what happened. The complainant gave them his neighbor"s name and address.
The complainant"s son and neighbor also gave statements. About two weeks later, the
complainant got an email saying APD wasn"t going to do anything because they didn"t have the
name or the address of the suspect. Detective Holmes AP6858 told him the complainant needed
to file a report online or go in person to file the report because there were no bruises. The
detective was kind of short with the complainant over the phone. The complainant requested a
call back from the Detectives Supervisor- Sgt Martin and hasn"t heard back yet. The complainant
tried to file the report online, but it kicked them off and said they needed to call the police. The
police report says that the neighbor only pushed the complainant, but the neighbor hit him twice
and then pushed him. There were witnesses and APD didn"t talk to them. Cause number 25-

Given the approximate value of the missing items, this matter clearly falls under grand theft, and I
am concerned about the lack of urgency. Specifically, I need clarity on whether the following
actions have been taken:
Has the detective personally visited local pawn shops?
Has he attempted to visit the residence of the former employee involved?
Has he contacted me to arrange a meeting with the current employee still on staff?
Has he had a thorough conversation with

I am writing as a family member and next-of-kin of
associated with APD case
24-2480038 and Medical Examiner case 24-05372. I am formally requesting a full review of the
handling and investigation of her death.
The Medical Examiner's investigative report contains several concerning procedural issues,
including:
The driver was allowed to wander freely around the scene prior to full scene control.
No field sobriety test or toxicology collection was performed at the scene.
The driver was permitted to leave the scene unaccompanied, reportedly to go to a hospital,
without police oversight.
Despite extensive traumatic injuries and unclear circumstances, the case was initially treated as
not involving foul play.
Given these issues, I respectfully request:
1. A formal review by Internal Affairs and/or the Office of Police Oversight regarding scene
handling and investigative procedures.
2. Access to all materials associated with the case, including body camera footage, officer notes,
911 call audio, witness statements, photographs, and any accident reconstruction.

statements so early with investigations. Why do y"all then say it is too early in the investigation to

were no signs of foul play and were declaring it a suicide before thoroughly investigating the
same day they found her body. As soon as her grieving parents hired an attorney they declared
her death a suicide not long after, before the medical examiner has even declared anything. Most

deaths of Hispanic students falling from the balcony of the same apartment. These deaths do not
coincide with typical suicidal behavior that usually tends to isolate beforehand. Lastly, even if

Complaint:
On the date of 10/19/2024, I was unlawfully apprehended by APD officer (9098)
along with other officer whom both were on foot. As I was strolling the downtown area
proceeding from W. 6th street heading eastward, I decided to stop and have a seat in an
alley in between Red River and Trinity caused by excessive walking and fatigue and to
converse with acquaintances. Thereupon officers approached me immediately stating
"place your hands behind your back", without providing legitimate probable cause of the
crime I allegedly committed. Neither was my rights Miranda rights read to me pertaining
to offense which police officers are required to read suspects according to Tx Code of
Criminal Procedure at some point during one's detainment. In addition, I declare this
matter of incident to be discrimination based on the fact that there were a crowd of
others whom which were sitting in the same area prior to my arrival given that officers
had to walk past an entire group of people to even approach me. Perez attempted to
justify actions by stating he gave several warnings to leave location whereas I was not
within vicinity if this was so nor did I hear precaution otherwise I would have obviously
obeyed order. Resulting of this situation is what led to failure to identify and resisting
arrest (caused by illegal arrest, harassment, violation of rights and assault by officers.
Officers involved assaulted me all because I expressed the need to fight for my rights and
not comply with their blatant misconduct. Officer Perez swelled my jaw on the right side
by aggressively pressing my face against the wall during arrest and others slammed me to
the ground while choking me as I screamed and pleaded I could not breathe. Repeatedly I
requested for medical however was ignored and denied, then forced into patrol vehicle
with both of my feet restrained, an unlawful act. Upon booking I was then informed of
charges pending which were: 1) violation of city ordinance offence only punishable by
fine); 2) failure to identify; 3) resisting arrest(2x). I was also assaulted by officer
Perez#9098) along with other sheriffs upon booking.

on to obtain her business and Master Degree from the University of Southern California. If I was
put in the Ms.

Twice in about two weeks police have put stickers on my two cars over parking violations,
However I cannot get any help for the constant lout music from several homes around and on
for the past year or more. It is interesting that neighbors are aloud to continuously
disrupt those around them for hours at a time, but vehicle parking violations are what is actually
addressed here. The noise is unbearable and I now hate Austin and plan on leaving. Anyone in
this area can attest to the fact that the same homes make it repeatedly hard for the rest of us to
have peace. These loud music sessions have been reported, then the noise lasted for over 12

On September 14th, 2025, I was a passenger in a vehicle when Austin Police Officer Badge #9919
unlawfully escalated a situation that had nothing to do with me. I was drinking, but I was not
driving, and there was no crime, no disturbance, and no legal reason for the officer to demand my
name or ID. Despite having no probable cause, he ordered both of us out of the car-forcing me to
stand outside without shoes-and then made me put my hands behind my back. He placed me in
the back of the police car with my hands cuffed backwards, causing immediate pain and damage
to my wrists. My wrists swelled so badly afterward that I couldn't even wear bracelets for weeks,
and now, in December, they still hurt. I continue to suffer emotional trauma from what he did. As
a former first responder from
, this officer's unjustifiable behavior has shaken
my trust in law enforcement entirely.
To make matters worse, the officer's misconduct continued when the lieutenant falsely accused
my husband of injuring my wrists-when it was Officer 9919 who caused the injury. My husband
merely touched my wrist because I told him it hurt. Despite that, the lieutenant had him arrested
while completely ignoring the real cause of my injury. The actions taken against both of us were
ridiculous, unjustified, and a violation of my constitutional rights in every possible way. I am
demanding a full investigation, interrogation of Officer 9919, review of body-camera footage,
disciplinary action up to removal, and compensation for the physical harm, emotional trauma,
and ongoing suffering caused by this officer's misconduct.

Holmes, Badge #6858, spanning at least six years. The incidents below, taken together with his
prior sustained disciplinary history, indicate a pattern that requires formal investigation.
1. Prior Sustained Discipline (Relevant History)? In IA Case 2019-0710, Detective Holmes
received a sustained finding and Oral Reprimand for using a tobacco product while engaged in
official police business, in violation of APD Policy 946.2 (public record).
2. May 2023 - Alleged Failure to Properly Investigate Assault Harassment?
In May 2023, a female victim filed a complaint alleging that Detective Holmes closed her assault
and harassment case despite her submission of evidence of physical injury, recent major surgery,
and ongoing harassment. The case was closed citing "lack of evidence." This closure appears
inconsistent with APD policies requiring thorough investigation of reported crimes, particularly

3. February 28, 2025 - Alleged Abuse of Authority and Retaliation ?On or about February 28,
2025, an individual received a telephone call from a person claiming to be law enforcement who
stated that a felony arrest warrant was about to be issued and that the recipient would become a
felon. ?When the recipient went in person to an Austin Police Department facility to verify the
claimed warrant, on-duty personnel informed them that Detective Holmes is not a police officer
(indicating he lacks authority to issue or execute warrants in that manner) and that the call was
likely a scam, as no warrant existed.? The recipient believes the call originated from Detective
Holmes and was made in retaliation for a police report the recipient had previously filed against
his own ex-girlfriend regarding the theft of the recipient's bicycle.? If substantiated, using (or
appearing to use) official authority to intimidate or retaliate against a citizen for filing a

investigation agreed to let us see the video. He stated before the video started that

walking back and forth across the street. Mind you, he didn't show us that part of the video. (I
know my son, no matter what, he had better sense than that).. Det. Gil practically rushed the
video and left us feeling some type of way. He had to re-do the police report several times. Stated
the driver had license when he didn't and other discrepancies. He didn't try to slow the video
down and blow up the second car's plates. I feel like he wasn't in our best interest at all. He and
his co-worker
gave me the impression that they weren't all in If you have a
position like that, I feel like you should have some compassion. They had to borrow the
laundromat's camera because the city has Springdale and MLK set up with a dummy camera.
Makes no sense at all. To top it all off, a year after
death, they put up a sidewalk.
(Ironic). So much more to say, this is a start. I'm so distraught, discouraged and disappointed
about how this whole case was handled. They need more training.

On 12/11/25, between 7:30 AM and 7:45 AM, at the Trinity Methodist Church parking lot at 44th
and Maybelle (northeast side), APD vehicle 9288 appeared to be doing nothing but stalking me - a
Straight Christian Man. When I started writing down the vehicle number for this complaint, while
standing on the public sidewalk, APD vehicle 9288 quickly drove right at me before pulling up
next to me, trying to intimidate me and make me move. I stood my ground, watching the APD
vehicle. The male police officer then asked me, "What"s up?" I did NOT respond. I simply stared
right back at him until he drove back to where he initially was in the parking lot. I kept looking
right at him until he finally, but too late, left a few minutes later. He did NOT appear to be
answering a call.
Identify and reprimand the guilty male officer so that he NE ER does that to me again anywhere.
This is the third such incident at the same place at about the same time of morning in the past 30
days - 11/15/25, between 7:10 am and 7:20 am, APD vehicle 2693 was the first and 11 27 25,
between 7:25 am and 7:30 am, APD vehicle 2689 was the second. Both of those incidents were
also documented with OPO.
I testified to the Public Safety Commission earlier this month that this alleged APD stalking
behavior will NOT be tolerated.

Video Surveillance Evidence Not Preserved
According to
the apartment complex manager, he informed Detective Tavera

stated that the elevator and building
footage had already been erased due to the delay.
indicated that the detective had
been advised earlier to come view the footage in person.
However, Detective Tavera later told me that he "thought" the videos were saved, which is
inconsistent with what the apartment manager states he clearly communicated.
As a result, potentially critical surveillance evidence appears to have been lost.
HEB Receipt Evidence - Urgent Concern
Additionally, a receipt from HEB was recovered from one of my stolen vehicles. This receipt
includes:
The store location
The date and exact time
The specific register used
Indication that a SNAP/EBT card (or similar assistance card) was used
This receipt may be one of the strongest investigative leads in the case, as it could potentially
identify the individuals involved.
Despite the urgency and the fact that retail surveillance footage is also subject to erasure,
Detective Tavera has not yet gone to HEB to view or secure the footage, nor has he followed up on
the SNAP/EBT information tied to the transaction.
I am very concerned this evidence may be lost as well if it is not addressed immediately.

I have made numerous attempts to contact Detective Tavera via phone calls and text messages
over many days. Responses have been rare and delayed, leaving me without updates or clarity on
whether critical investigative steps are being taken.

I am submitting this as a formal complaint regarding the conduct of several Austin Police
Department officers involved in my DWI investigation on [date]. Although I was ultimately
released at the scene and not transported or booked, the incident raises serious concerns about
training, accuracy, and adherence to APD procedures. The case was later dismissed.
During the stop:
I passed all standardized field sobriety tests.
I passed the breath test.
No odor of marijuana was noted.
I did not admit to using any substance.
No Drug Recognition Expert (DRE) evaluation was conducted.
No physiological indicators of impairment were documented.
A trainee officer made the primary impairment determination.
Despite the absence of evidence indicating impairment, I was detained for approximately 92
minutes. My vehicle was searched, and the detention appeared to be based solely on possession
of vape pens and the officer's subjective interpretation of my eyes. No standardized drug
impairment protocol was followed.
At the conclusion of the detention, the officer apologized for the situation and offered me a
courtesy ride, acknowledging that the arrest decision was not supported. I was released at the
scene without transport or booking. I am requesting that APD:
Review the body worn camera footage and the arrest report.
Evaluate whether proper procedures were followed.
Determine whether the trainee officer received appropriate supervision.

On 12/11 I was arrested. I was walking from down Cesar Chavez and was a few blocks from the
Terrazas library when I stopped to rest and set down my belongings for a moment. A security
guard across from the car lot close to the westbound bus stop told me I could not be there. Police
were called, and showed up in a very aggressive manner while I was walking away on the
sidewalk. The first police officer showed up alone and tried to grab me, but I didn"t know what
for. He could not grab me or get a grasp on me so they proceeded to use extra force and a taser
gun. Another unit arrived about 2 minutes later in a different vehicle and they both tased me at
the same time. I was handled very roughly, with tight handcuffs and bending and twisting my
wrists so forcefully that I received deep and open wounds on my wrists and arms from the
handcuffs, serious enough that I needed medical attention, wound care, and am on a course of
antibiotics to treat these injuries (photos are attached, taken today, one week after the incident).
During this incident I do not believe body cams were on but a dash cam was. The physical police
brutality lasted from the police officers who showed up to the intake to the correctional officers
that are in central booking twisting my wrists, left and right and tightening the handcuffs which
were never loosened. The resulting wound is still open.

creating a hostile work environment by pursuing investigations that are baseless. One such

Eads last year (all exonerated). This investigation was retalliation for not siding with Henderson,

hours over a weekend to move it. No one informed him about it, until a neighbor checked in to

He was in a small collision. He called 311 and they told them because it was a small incident, to go
ahead and exchange insurance information. The woman he was in the collision with believed that
the complainant"s information was false, so she called APD. Four hours later, APD showed up.
APD said they wouldn"t write a report, but took his information down to verify it, then gave back
his driver"s license and insurance information and said that he could leave. When he filed a claim
with his insurance this morning, they told him the other party"s insurance was incorrect. The
complainant is concerned that only his information was validated and not hers and feels he was
being discriminated against.

Leaving work from lakeline mall coming out at the intersection of rockstop blvd and ridgeline
blvd but there was a bad two car accident that was blocking the intersection.
I was going to try and make a U turn to go back into the mall i assumed traffic was being rerouted
like it usually is during a terrible car accident but the cop ran towards my car screaming and
shouting, I rolled my window down to understand him but he continued screaming at me i was
immediately overwhelmed trying to comprehend what was happening i told him my ID was in my
phone case which was in the passenger side of my car he continued screaming then he reached
into my car to try and open my door when my car wasn't in park yet and i was diagonal in the
middle of the road. He was extremely aggressive and i was scared and couldn't even process what
was happening. He then took my ID and left me in the car for over 40 minutes while he never
attended to the people in the car crash. During the whole time he never payed attention to the
people from the accident while the victims tried telling him multiple times one person in their
party was dizzy and not feeling good the ambulance was not called to the scene while both cars
where totaled and airbags deployed. i was extremely aggressive and im terrified to think about
what would have happened if he took me out of the car.

I was assaulted by my ex boyfriend on December 20th. He tackled me from behind, pinned my

Officers Kitt and Sanchez conducted a traffic stop of my vehicle in downtown Austin. From the
beginning of the encounter, Officer Kitt (Badge #9452) acted in an aggressive and unprofessional
manner, including striking the vehicle window with his flashlight and speaking to us in a hostile
tone. Two minors, ages 16 and 12, were present in the back seat. We were not initially informed
of the reason for the stop and were immediately questioned about weapons. After my boyfriend
disclosed possession of a legally registered firearm, he was handcuffed and placed in a patrol
vehicle. Officer Kitt later stated the stop was due to failure to signal and a non-functioning license
plate light, which we dispute, as the turn signal was used and the vehicle has not previously had
issues with the license plate light. The vehicle was searched multiple times while we were
repeatedly questioned about drugs and firearms, despite no illegal items being found. Officer
Sanchez questioned my 12-year-old brother about drugs in his backpack, which I believe was
inappropriate given his age. Despite multiple searches yielding no evidence, we were told there
was marijuana residue in the vehicle, which is not accurate.
Reason for Complaint:
Based on the totality of the encounter, I believe we were unfairly profiled and treated in an
intimidating and disrespectful manner, particularly by Officer Kitt. The conduct displayed did not
align with professional standards expected of Austin Police Department officers and caused me to
feel threatened rather than protected.

I am submitting this formal complaint regarding the conduct of Sergeant Knodel Badge# 7855]

, during an incident
involving damage to my tow truck caused by a vehicle that was being operated under its own
power on my tow deck.
1. Summary of Incident
While my company was performing a lawful repossession, the vehicle owner entered the vehicle,
operated it under its own power, and attempted to drive off my tow truck. During this movement,
the vehicle struck and damaged my tow truck and equipment. I contacted police so the matter
could be properly documented as a collision, and so the required exchange of information-
including insurance information-could occur.
2. Officer Incorrectly Stated It Was "Not a Collision"
Sergeant Knodel Badge# 7855 stated that the event was "not a collision" and refused to classify it
as such. This statement was legally incorrect.
Under Texas Transportation Code § 550.022 (Collision Involving Damage to Vehicle), the duty to
stop and exchange information applies when:
"The operator of a vehicle [is] involved in a collision resulting only in damage to a vehicle that is
driven or attended by a person."
My tow truck was clearly attended by my employee, and the other vehicle was clearly operated
and under the driver's control. The movement of that vehicle caused direct damage to my
attended vehicle.

This meets all statutory elements of a collision, regardless of where it occurred or what
terminology the officer chose to use.
Courts have repeatedly held that the statutory duties after a collision depend on the facts of the
event, not on an officer's subjective description:
Mokuolu V. State, 2003 WL 21235555 (Tex. App.-Texarkana):
Duties attach when a vehicle is involved in an accident causing property damage.
Kacz V. State, 2009 WL 5155548 (Tex. App.-Houston [14th Dist.]):
§ 550.022 is triggered by any damage to an involved vehicle.
Reynolds V. State, 2024 WL 1096350 (Tex. App.-Tyler):
Reiterates the statutory language of "collision involving damage to a vehicle that is driven or
attended by a person."
Nowhere in Texas law does an officer have discretion to redefine what is or is not a collision when
the factual statutory elements are plainly met.
3. Sergeant Knodel Badge# 7855 Refused to Facilitate Required Insurance Exchange
After misclassifying the event, Sergeant Knodel Badge# 7855 refused to obtain or provide the
other operator's insurance information.
This directly contradicts Texas Transportation Code § 550.023, which requires:
The operator of a vehicle involved in an accident resulting in damage to a vehicle that is driven or
attended by a person shall:
(1) Give their name and address;
(2) Provide the registration number of their vehicle;
(3) Provide the name of their liability insurer;
(4) Show their driver's license if requested and available.
Because the event was legally a collision causing damage to my attended vehicle, the officer
should have ensured compliance with § 550.023 and documented the driver's insurance
information.
4. Officer Failed to Fulfill Statutory Duties to Investigate
Under Texas Transportation Code § 550.041, an officer who is notified of a motor vehicle collision
causing property damage may investigate regardless of where it occurred, including private
property.
Under Texas Transportation Code § 550.062, once an officer begins investigating a motor vehicle
collision, he must complete a written report if the damage is ? $1,000.

Alonzo V. State, 2008 WL 495164 (Tex. App.-Austin), held: Once dispatched to an accident, an
officer has a duty to determine whether the event constitutes a reportable collision, and if so,
must file a collision report.
Sergeant Knodel Badge# 7855 refused to acknowledge or evaluate the property damage, failed to
determine whether the damage exceeded the $1,000 reportable threshold, and instead
prematurely dismissed the event as "not a collision."
5. Statutory and procedural failures
Based on the statutes and case law above, Sergeant Knodel Badge# 7855: Incorrectly and
unlawfully refused to classify the event as a collision; Refused to enforce the duties under §
550.022 and § 550.023; Incorrectly treated a factual collision as a non-event; Failed to assist in
the required exchange of insurance information; Failed to follow the statutory framework
governing collisions on private property. These actions prevented proper documentation of the
incident, obstructed the lawful exchange of insurance information, and caused material harm to
my company as the victim of the collision.
6. Requested Actions
I respectfully request that the department: Conduct a full Internal Affairs investigation into
Sergeant Knodel Badge# 7855 actions; Determine why § 550.022 and § 550.023 were not
enforced; Provide retraining to the officer in the proper classification of collisions and statutory
duties after a collision; Provide a written response detailing investigative findings and corrective
actions. Provide me with the other drivers insurance information as required by law.

Austin Police Department Officer, in traffic, became unprofessional in the roadway, when driving
recklessly. That assaulted a professional. The officer continued, recklessly to cause a hostile work

I am absolutely furious about a complaint made against my son's father that turned into an arrest
warrant.

baby. Early summer,
has threatened that if he doesn't sign over his parental rights, that he
would be going to jail on baseless claims of domestic and physical abuse. She has lied and
coached her daughter to file a complaint of sexual contact with her underage teenage daughter.
Williamson county sheriff completed their investigation and the DA refused to take the case due
to concerns of retaliation and coaching. (attached is the DA letter). She has filed multiple
baseless CPS complaints on my son and their baby which all have been closed or not taken
further than an initial intake. She has called in complaints to multiple law enforcement agencies
across Williamson County and Travis County (and recently Hays County) on the baseless claim
that he is stalking and harassing her or kidnapping their baby. (which he has sole custody of as a
result of their 3rd and final custody hearing on Oct 31)
This leads us to the incident on Oct 16 where
tried to talk to her while they were
on the road in Austin near Airport Blvd. He wanted to tell her about the order for a Writ of
Habeas Corpus that was granted by Judge Terrance Davis of Williamson County but due to her
suspicious behavior in the car with her phone, he decided not to continue communication. She
took this incident and decided to file an "impersonation of law enforcement officer" claim.
Somehow, this was processed WITHOUT EVER CONTACTING
and it then turned
into an arrest warrant.
His family had to come together and spend $10K on an attorney to get his bond and help fight this
BASELESS charge. As the attorney was reading the police report, we all were absolutely baffled at
the absurdity of the details. "He threw a badge in through her car window". A person
impersonating a law enforcement officer is going to throw his badge in through her car window??
She also stated there as an unopened package which was given to her by

had an Apple Watch which must be how he tracked her. YOU HAVE TO LINK AN APPLE WATCH

next month to talk about this event.
Also, with an arrest warrant, my son (and even his friends) could have been in the car with him
and if he had gotten pulled over for something simple like not coming to a complete stop at an
intersection, he could have been arrested on the spot with my son witnessing that type of
traumatic event.
If a simple investigation was done a simple call to

I am 67 years old and have been assaulted twice by the same person during the last 2 months. I
filed a police report each time. No action was taken on either.
The first police report (#2025-9028253) was accepted by APD. But no action was taken. And no
communication with me was attempted.
The second police report (temporary reference #2585827) was rejected with the notation that I
should have called 3-1-1 at the time of the incident instead of filing a formal report.
After the second non-action, I complained to Chief Lisa Davis. But she also did nothing.
I had thought that one of the top priorities of APD is to protect the elderly. That appears to have
been a misapprehension on my part.
