On April 22, 2022, the OPO received a phone complaint.
The complainant alleges: The complainant bought a house in Austin from her sister's boyfriend.
This sale was finalized in
and the complainant is now the sole owner of the home. The
boyfriend repeatedly returns to the house despite the complainant's protestations. The police have
previously been called to ask the boyfriend to leave the premises. The boyfriend has been issued a
CTN at the property, but the complainant has been told it does not apply when her sister is not
living at the home.
days ago, the complainant received information that the boyfriend was
once again at and inside the home. She then called the police to have him removed and arrested.
The police did not arrest him and only told him to leave. The complainant wants to know why the
boyfriend was not arrested when he was clearly in the home. She is not okay with someone
breaking into the home and damaging and stealing property. The damage caused by the boyfriend
when he was inside the home is costing her hundreds and thousands of dollars. Also, the
complainant asked to be updated about the incident but was not kept up to speed by the officers
during the interaction. The police later told her that since they did not witness him inside the house
they cannot arrest him, and she does not understand this logic. She expressed she wanted him
arrested for the damage he caused and the officers did not take action. The officers merely warned
him and were overly nice to a malicious individual who caused her hardship. The officer told the
complainant to "sell the home and move on". The complainant plans on using the home and
therefore this is not a viable solution. The officer told the complainant, "This is different because
he was the previous owner", even though he has no ownership of the house during the date of the
incident. The complainant doesn't know where this officer is getting this information and wants to
understand why the decision was being made. This isn't the first time the boyfriend has broken in
and in previous times she found drug paraphernalia (meth and meth pipes) which he left there. The
complainant has young children and is concerned for the influence this may have. She has textual
evidence of the boyfriend's presence at the house. The complainant believes the boyfriend will not
leave them alone until he gets everything he thinks he's deserved. The boyfriend has threatened
suicide and to injure the complainant's sister when he returns to the house. She will hold APD
accountable for not taking action.
