[badge #9115] re: APD Case No. 24 - 3090425 on November 4, 2024 at about 8:50 AM at CAP
METRO bus stop 690 on Medical Parkway between 40th and 42nd. Officers Clancy [badge #8382]
and Sim [badge #9115] were called out to CAP METRO Bus #2215 at Stop 690 by guilty Hispanic
Male bus driver - Operator #303220.
Guilty Hispanic Male bus driver - Operator #303220 was the one ILLEGALLY DELAYING SERVICE
by wrongly REFUSING to drive forward with me,
, on the bus, though I had paid my
fare like every other Passenger. I was rightly standing by my gear in the seats across from the rear
doors, AWAY from guilty Hispanic Male bus driver - Operator #303220. However, guilty Hispanic
Male bus driver - Operator #303220 allegedly told CAP METRO Security/APD that I was the
problem delaying service, meaning guilty Hispanic Male bus driver - Operator #303220 allegedly
MADE A FALSE REPORT TO A PEACE OFFICER - VIOLATING Texas Penal Code 37.08 (a)(1). In
fact, guilty Hispanic Male bus driver - Operator #303220 was allegedly ILLEGALLY retaliating
against me for telling him to FOLLOW THE LAW after he told me he wouldn"t transport me again
because a CAP METRO complaint was being filed against him for intentionally and unnecessarily
stopping past boarding Stop 689, violating CAP METRO policy and procedure.
White Male Officer Clancy [badge #8382] and Asian Male Officer Sim [badge #9115] mistakes
follow:
1) They believed guilty Hispanic Male bus driver - Operator #303220"s BULLSHIT
Instead of rightly asking me what was going on, they wrongly assumed guilty Hispanic Male bus
driver - Operator #303220 was telling CAP METRO, and them, the truth. Therefore, they NEVER
listened to me while I was on the bus. They boarded and Officer Clancy [badge #8382] told me to
get off the bus, though I had the right to be on that bus and be transported to my destination stop.
Therefore, without investigation, they wrongly rewarded guilty Hispanic Male bus driver -
Operator #303220"s alleged CRIMINALITY and wrongly punished my law-abiding, self-defense

words and actions. That"s UPSIDE-DOWN, ASS-BACKWARDS, and WRONG. They"re supposed to
serve me, a member of the public, by PROTECTING me from alleged criminals like guilty Hispanic
Male bus driver - Operator #303220.
Though they said they would speak with me outside the bus, I knew the bus would take off and
leave me at Stop 690 as soon as I exited. Officers Clancy [badge #8382] and Sim [badge #9115]
allegedly wanted that outcome because they seemed to wrongly believe I was delaying service,
though I wasn"t.
In that situation, they should have called for a CAP METRO Supervisor to arrive on scene because
guilty Hispanic Male bus driver - Operator #303220 should have been removed for delaying
service, NOT me.
2) Officer Sim [badge #9115] told me he believed this was the third time he had been called out
on me, implying I am a multiple repeat offender/problem of some kind
The truth is many CAP METRO bus drivers target me, a whistleblower, with their rule-breaking
and/or ILLEGAL behavior, resulting in APD being called out for me rightly and lawfully defending
my public transportation civil rights from their attacks. Those guilty drivers are the problem, NOT
me.
3) Officer Sim [badge #9115] tried gaslighting me by telling me CAP METRO was a private entity,
allegedly to justify CAP METRO telling APD to ILLEGALLY remove me from Bus #2215 without
just cause
I immediately corrected Officer Sim [badge #9115], telling him CAP METRO is public
transportation defined and governed by Texas Transportation Code - Chapter 451. In fact, CAP
METRO has a legal obligation to do mass transit - "the transportation of Passengers and hand-
carried packages or baggage of a Passenger by a surface, overhead, or underground means of
transportation, or a combination of those means, including motorbus... per said code
451.001(a)(2).
I also cited In VIA Metro Transit V. Meck [620 S.W.3d 356 (Tex. 2020)], the Texas Supreme Court"s
ruling clearly distinguishing common carrier CAP METRO from private carriers, like Greyhound:
"To qualify as a common carrier (in contrast to a private carrier), the entity must provide
transportation services to the general public, as opposed to providing such services only for
particular individuals or groups." In other words, because CAP METRO is NOT a private carrier, it
CANNOT deny service without just cause like Greyhound can. Therefore, Officers Clancy [badge
#8382] and Sim [badge #9115] should have helped me legally exercise my civil rights to stay on
the CAP METRO public transportation bus and ride it to my destination stop.
4) Officer Clancy [badge #8382] told me CAP METRO could CTN me from specific busses and/or
routes
I immediately responded, telling Officer Clancy [badge #8382] public CAP METRO has to have
legal just cause to issue a CTN against a Passenger for a bus or bus route, unlike private

businesses that can refuse service and/or tell a customer to leave at any time for any reason or no
reason at all. Officer Clancy [badge #8382] then respectfully suggested I monitor my bus
behavior, allegedly to not give CAP METRO just cause to issue a CTN against me. He also
acknowledged me telling him I am being targeted by some bus drivers, including guilty Hispanic
Male bus driver - Operator #303220.
In conclusion, though Officers Clancy [badge #8382] and Sim [badge #9115] rightly did NOT
detain or arrest me, the professional interaction between them and me was still a wrong step
backwards for APD with respect to being called out by CAP METRO to a non-emergency situation.
Simply believing what CAP METRO told APD, without on scene investigation, was the old, WRONG
way. The new, RIGHT way is to arrive on scene, speak with a CAP METRO bus driver and/or
supervisor, and speak with the Passenger, to hear from each what happened, when, where, how,
and why, before making any determinations or decisions. Also, because CAP METRO busses have
real-time recorded video and audio on multiple cameras inside and outside their busses, APD can
also use that evidence to verify in-person testimony, then and there, before taking action.
Therefore, make sure ALL APD officers responding to CAP METRO calls hear and know this
complaint"s information. Only respond the RIGHT way moving forward.
Immediately place this complaint in Officers Clancy [badge #8382] and Sim [badge #9115]"s
personnel files. In addition to appropriate punishment, use it as a professional development
opportunity for them, and ALL APD officers, so the old, wrong way NEVER happens again on a
CAP METRO call. The new, RIGHT way to interact with and work for the public APD officers have
sworn to protect and serve is how to Make Austin Great Again.

He was calling to complain against Jesse Franco for making harassing phone calls. He called APD
to make this report, but they told him he needed to file the report in the location this is
happening. He lives in California, and these calls are coming from Officer Franco, in Austin, to
their phones in California. This officer's ex-girlfriend is dating the complainant currently. The
complainant stated that the officer continues to call them. The officer also looked up the
complainant and accused him of having a harassment charge against him in Austin even though
he does not. The complainant has video of this officer confessing to looking up the complainant
and also making continuous calls. He keeps calling the complainant's number, the ex-girlfriend's
number and the ex-girlfriend's place of work. The complainant and ex-girlfriend have blocked
him on all social media, but the officer continues to call them on "spoofed" and unknown
numbers.

immediately that the complainant had two knives on them. The complainant handed him the
knives. The officer then conducted a full search, and not just a regular pat down. When he did
that, the officer groped their rear end. On the case report the officer wrote that the complainant
had schizophrenia because the mother told them that, even though the complainant states they
don't have schizophrenia.
While the complainant was in the car with Officer Omar James AP8919 being transported to the
hospital the officer gave the complainant a fake name. The complainant asked the officer why the
back camera wasn't on, then the officer began swerving. The officer then asked if the complainant
had voted yet. The complainant was made uneasy by some remarks the officer made after that
and is worried that cameras weren't on in the cruiser to capture those comments. The comments
made the complainant feel as though the officer was right wing and could be discriminating
against the complainant for being trans.
When they got to the South Austin Medical Center, they took the complainant's belt, shoelaces,
sweater and wallet. The complainant states they were sedated and attacked.
The officer was sitting at the desk talking about politics and talking about the complainant with
the medical staff at this time.

This is not my direct experience with the police officers however, a family friend has confided
with the following information about an incident that occurred last night;
At around 2am-3am the 'detainee' (my friend) was getting a ride in an Uber on the way home
from a night out in Austin. A police car pulled the Uber driver over off the road and asked both my
friend and the Uber driver to get out of the car.
The police officer took my friends wallet and knocked my friends phone out of their hand which
then fell in a drain. There were no reasonable causes provided by the questioning officer as to
why both my friend and the Uber driver were being detained or why they pulled my friend out of
the safety of the Uber car taxi in the first place.
The officer subjected my friend to a humiliating interrogation which ultimately led my friend to
walking alone at night and unsure of their own location. My friend no longer had their phone or
wallet and since the officers let the Uber driver go; my friend was completely alone having to try
to find a way back home. They didn't know where they were. My friend had to walk and find
someone who could help get them back home.
This is a very traumatic story told by my friend and I am absolutely disgusted with the conduct of
these Austin police officers by putting my friend on the streets while they were being driven
safely home by an Uber driver. All by some officers not following their oath to our community,
putting my friend in danger, taking their wallet and damaging their phone without any
reasonable cause for being detained in the first place. What were the police officers intentions
here aside from intimidation and neglect? My friend has every right to sue these police officers
for damages.
The officer had red hair and the second officer was hispanic but mostly just watched the ordeal.
The red haired Caucasian officer was the one interrogating my friend. The Uber driver is also a
witness for the beginning of this incident.
This incident occurred on early Saturday morning around 2-3am- on 10/12/24

Complainant state that her father in-law is a United Nations Diplomat, and the officer refused to

but if they arrived after the event was over to please come to my apartment # 104. They never
showed up at the event and they never came to my apartment. This happened also on Saturday,

He was riding Cap Metro bus line 383 NB and it collided with another vehicle. The complainant

I would like to inform the OPO and APD about the actions of one of your officers. Let me start by
saying that, I do not know what the officer's name or badge number is, or patrol vehicle because I
was not pulled over. But I would have been if I had not turned into the gate at my job, which
would have been an unlawful stop. Between the times of 4:30am - 4:45am this morning, I was on
Tillary street in East Austin going to work. I saw a APD patrol vehicle at a stop sign that almost
pull out in front of me, but he backed up. As I passed by, he turned and started to follow me, I
know this because of what happened next. On Tillary there is a back gate to get to my job, and as I
turned in to my job to badge in, the patrol vehicle stopped at the entrance as I was badging in the
gate. He waited until the gate started opening to leave. I cannot tell you how frustrating that made
me feel. I did not break any traffic violations, laws, or involved in anything criminal so what is the
reason for following me. This is one of the many reasons the community and APD have a bad
relationship with each other. Where is the trust? A guy is just trying to go to work with potentially
getting harassed by APD, great way to start the work day right?
I understand that the new Chief has a 100 day plan which includes community trust and to quote
one of her statements "I must take time to listen to your experiences and concerns". Well, this is a
concern that definitely needs to be listened to. I try to support the APD and I have friends that
have worked on the force but situation like this hurts APD more than you know. So, I hope this
message finds it's way to the Chief and definitely I am willing to have a conversation about this
situation. I sure hope that you can speak with the officer as well. Like I said, I was not pulled over
but APD does have GPS on the vehicles and maybe you can find out who was patrolling Tillary at
the times that I gave and speak to them. I will end this by saying this. Me or anyone else should be
able to go to work no matter what time it is without the potential of getting harassed and I really
hope APD does better by the community.

Upon contacting the Wilco Sheriff's Office, we were informed that the incident should be handled
by the Austin Police Department (APD).
Transfer to 9-1-1:
We were transferred back to 9-1-1, where we were informed that the dispatcher notes incorrectly
reported "no injuries." We were provided with the EMS/Fire report number (243270322) and
instructed to call Austin 3-1-1.
Attempts with Austin 3-1-1:
After contacting Austin 3-1-1, the operator directed us to submit the report online through the I-
Report system. Despite making four attempts, the system repeatedly failed to process the report
due to the inclusion of injuries and a towed vehicle. The 3-1-1 operator refused to assist in
contacting an officer, despite being informed of the system's failure.
Visit to APD North Station:
Frustrated by the lack of progress, I drove to the APD North Station. A city employee on site was
finally able to assist by contacting dispatch and having an officer sent to meet me.
Resolution:
The officer who arrived filed the incident report, with the assigned report number being 24-
3270910.
Delays and Demands:
The accident occurred at 6:00 AM, and the incident report was not filed until 2:40 PM. This 8-
hour delay, caused by dispatcher errors, miscommunication between agencies, and failures of the
I-Report and 3-1-1 systems, severely hindered the timely investigation of this serious hit and run.
The negligence displayed throughout this process is unacceptable and warrants immediate
attention. I demand a full review of the failures in this case and prompt updates on the progress
of the investigation. Any further mishandling of this matter could compromise the investigation
and erode trust in the department's ability to protect and serve.
We reserve the right to pursue additional actions if these issues remain unresolved or if the
delayed response impacts the outcome of this case.

I came across this video which includes a clip of an interaction with an Austin Police Officer
which I believe need to be scrutinized. See time stamp 8:19.
I'm not sure of the date of this interaction but felt compelled to follow up to ensure the safety and
rights of all citizens are protected from officers who abuse their authority. Particular attention for
officers needs to be the 1st 4th and 5th amendments of the US Constitution.
The officers behavior did not bring good credit to your department and shows a disrespect to
those they swore an oath to protect their constitutional rights. This officer is seething ego. A
person with a badge and a gun with that kind of ego is a very dangerous combination. This is but
one officer and one encounter with that officer. The problem is thousands of citizens have now
seen this video and it makes every officer look bad. The question then becomes, is the problem
systemic. Does the culture and attitude of your department align with your core values and
mission?
It amazes me that Departments have yet to become aware that citizens are becoming more aware
of their rights and filming police interactions is a very common trend that continues to grow. I
believe this is a training opportunity. Unfortunately, an ego is a very difficult thing to train.

Though they said they would speak with me outside the bus, I knew the bus would take off and
leave me at Stop 690 as soon as I exited. Officers Clancy [badge #8382] and Sim [badge #9115]
allegedly wanted that outcome because they seemed to wrongly believe I was delaying service,

In that situation, they should have called for a CAP METRO Supervisor to arrive on scene because

2) Officer Sim [badge #9115] told me he believed this was the third time he had been called out
on me, implying I am a multiple repeat offender/problem of some kind
The truth is many CAP METRO bus drivers target me, a whistleblower, with their rule-breaking
and/or ILLEGAL behavior, resulting in APD being called out for me rightly and lawfully defending
my public transportation civil rights from their attacks. Those guilty drivers are the problem, NOT
me.
3) Officer Sim [badge #9115] tried gaslighting me by telling me CAP METRO was a private entity,
allegedly to justify CAP METRO telling APD to ILLEGALLY remove me from Bus #2215 without
just cause
I immediately corrected Officer Sim [badge #9115], telling him CAP METRO is public
transportation defined and governed by Texas Transportation Code - Chapter 451. In fact, CAP
METRO has a legal obligation to do mass transit - "the transportation of Passengers and hand-
carried packages or baggage of a Passenger by a surface, overhead, or underground means of
transportation, or a combination of those means, including motorbus... per said code
451.001(a)(2).
I also cited In VIA Metro Transit V. Meck [620 S.W.3d 356 (Tex. 2020)], the Texas Supreme Court"s
ruling clearly distinguishing common carrier CAP METRO from private carriers, like Greyhound:
"To qualify as a common carrier (in contrast to a private carrier), the entity must provide
transportation services to the general public, as opposed to providing such services only for
particular individuals or groups." In other words, because CAP METRO is NOT a private carrier, it
CANNOT deny service without just cause like Greyhound can. Therefore, Officers Clancy [badge
#8382] and Sim [badge #9115] should have helped me legally exercise my civil rights to stay on
the CAP METRO public transportation bus and ride it to my destination stop.
4) Officer Clancy [badge #8382] told me CAP METRO could CTN me from specific busses and/or
routes
I immediately responded, telling Officer Clancy [badge #8382] public CAP METRO has to have

real-time recorded video and audio on multiple cameras inside and outside their busses, APD can
also use that evidence to verify in-person testimony, then and there, before taking action.
Therefore, make sure ALL APD officers responding to CAP METRO calls hear and know this
complaint"s information. Only respond the RIGHT way moving forward.
Immediately place this complaint in Officers Clancy [badge #8382] and Sim [badge #9115]"s

Though they said they would speak with me outside the bus, I knew the bus would take off and
leave me at Stop 690 as soon as I exited. Officers Clancy [badge #8382] and Sim [badge #9115]
allegedly wanted that outcome because they seemed to wrongly believe I was delaying service,
though I wasn"t.
In that situation, they should have called for a CAP METRO Supervisor to arrive on scene because
guilty Hispanic Male bus driver - Operator #303220 should have been removed for delaying
service, NOT me.
2) Officer Sim [badge #9115] told me he believed this was the third time he had been called out
on me, implying I am a multiple repeat offender/problem of some kind
The truth is many CAP METRO bus drivers target me, a whistleblower, with their rule-breaking
and/or ILLEGAL behavior, resulting in APD being called out for me rightly and lawfully defending
my public transportation civil rights from their attacks. Those guilty drivers are the problem, NOT
me.
3) Officer Sim [badge #9115] tried gaslighting me by telling me CAP METRO was a private entity,
allegedly to justify CAP METRO telling APD to ILLEGALLY remove me from Bus #2215 without
just cause
I immediately corrected Officer Sim [badge #9115], telling him CAP METRO is public
transportation defined and governed by Texas Transportation Code - Chapter 451. In fact, CAP
METRO has a legal obligation to do mass transit - "the transportation of Passengers and hand-
carried packages or baggage of a Passenger by a surface, overhead, or underground means of
transportation, or a combination of those means, including motorbus... per said code
451.001(a)(2).
I also cited In VIA Metro Transit V. Meck [620 S.W.3d 356 (Tex. 2020)], the Texas Supreme Court"s
ruling clearly distinguishing common carrier CAP METRO from private carriers, like Greyhound:
"To qualify as a common carrier (in contrast to a private carrier), the entity must provide
transportation services to the general public, as opposed to providing such services only for
particular individuals or groups." In other words, because CAP METRO is NOT a private carrier, it
CANNOT deny service without just cause like Greyhound can. Therefore, Officers Clancy [badge
#8382] and Sim [badge #9115] should have helped me legally exercise my civil rights to stay on
the CAP METRO public transportation bus and ride it to my destination stop.

their phones in California. This officer's ex-girlfriend is dating the complainant currently. The
complainant stated that the officer continues to call them. The officer also looked up the
complainant and accused him of having a harassment charge against him in Austin even though
he does not. The complainant has video of this officer confessing to looking up the complainant
and also making continuous calls. He keeps calling the complainant's number, the ex-girlfriend's
number and the ex-girlfriend's place of work. The complainant and ex-girlfriend have blocked
him on all social media, but the officer continues to call them on "spoofed" and unknown
numbers.

The complainant's mother called the cops on them. Nathan Taylor AP7881 somehow knew
immediately that the complainant had two knives on them. The complainant handed him the
knives. The officer then conducted a full search, and not just a regular pat down. When he did
that, the officer groped their rear end. On the case report the officer wrote that the complainant
had schizophrenia because the mother told them that, even though the complainant states they
don't have schizophrenia.
While the complainant was in the car with Officer Omar James AP8919 being transported to the
hospital the officer gave the complainant a fake name. The complainant asked the officer why the
back camera wasn't on, then the officer began swerving. The officer then asked if the complainant
had voted yet. The complainant was made uneasy by some remarks the officer made after that
and is worried that cameras weren't on in the cruiser to capture those comments. The comments
made the complainant feel as though the officer was right wing and could be discriminating
against the complainant for being trans.
When they got to the South Austin Medical Center, they took the complainant's belt, shoelaces,
sweater and wallet. The complainant states they were sedated and attacked.
The officer was sitting at the desk talking about politics and talking about the complainant with
the medical staff at this time.

24303412 and D -1-DC 24303411 issued by CITY OF AUSTIN MUNICIPAL COURT
The arrest warrant was based on a sworn affidavit by Richard Smith of Austin Police Department
transaction and sends wiring instructions .m4a after the Judgement was

Defendant alleges that errors were made by law enforcement in the issuance of the warrant,
which invalidates its legality under the Texas Code of Criminal Procedure, Article 18.01, and
relevant Texas Rules of Procedure. The Mortgage Company rescinded the payoff, and Spartan
Title accepted the payments.
The arrest warrant improperly issued due to errors in the affidavit or procedure by law
enforcement, specifically:
1. Lack of Probable Cause: The affidavit lacks sufficient evidence to establish probable cause for
issuing the arrest warrant, as required by the Texas Code of Criminal Procedure, Article 18.01(b).
2. Errors in Affidavit: The affidavit contains factual inaccuracies, omissions, or
misrepresentations by the arresting officer that undermine its validity. These errors violate the
Texas Code of Criminal Procedure, Article 18.01(c), requiring accurate and truthful statements
under oath.
Improper Execution of Warrant: Law enforcement did not comply with the procedures required
for a lawful execution of the warrant as outlined in the Texas Code of Criminal Procedure, Article
15.25.
Violation of Defendant"s Rights: The errors and omissions constitute a violation of Defendant"s
Fourth Amendment rights under the U.S. Constitution, which protects against unreasonable
searches and seizures.
An automatic stay was in place when Spartan Title attempted to sell the home before May 17,

This is not my direct experience with the police officers however, a family friend has confided
with the following information about an incident that occurred last night;
At around 2am-3am the 'detainee' (my friend) was getting a ride in an Uber on the way home
from a night out in Austin. A police car pulled the Uber driver over off the road and asked both my
friend and the Uber driver to get out of the car.
The police officer took my friends wallet and knocked my friends phone out of their hand which
then fell in a drain. There were no reasonable causes provided by the questioning officer as to
why both my friend and the Uber driver were being detained or why they pulled my friend out of
the safety of the Uber car taxi in the first place.
The officer subjected my friend to a humiliating interrogation which ultimately led my friend to
walking alone at night and unsure of their own location. My friend no longer had their phone or
wallet and since the officers let the Uber driver go; my friend was completely alone having to try
to find a way back home. They didn't know where they were. My friend had to walk and find
someone who could help get them back home.
This is a very traumatic story told by my friend and I am absolutely disgusted with the conduct of
these Austin police officers by putting my friend on the streets while they were being driven
safely home by an Uber driver. All by some officers not following their oath to our community,
putting my friend in danger, taking their wallet and damaging their phone without any
reasonable cause for being detained in the first place. What were the police officers intentions
here aside from intimidation and neglect? My friend has every right to sue these police officers
for damages.
The officer had red hair and the second officer was hispanic but mostly just watched the ordeal.
The red haired Caucasian officer was the one interrogating my friend. The Uber driver is also a
witness for the beginning of this incident.
This incident occurred on early Saturday morning around 2-3am- on 10/12/24

kept telling her they weren't coming. She called about 5 times and no one ever came. She stated
she felt like this was because they don't care about her. She stated that in the past she's had

He was riding Cap Metro bus line 383 NB and it collided with another vehicle. The complainant
was injured. He called 311 and left a statement with them. They gave him a reference number SR
24-00384468. The 311 dispatcher did not explain that he would be receiving a call from an
officer. He hired a lawyer, and the lawyer let him know there was no police report for that day. He
ended up going to APD headquarters downtown to obtain or purchase a copy of the report. The
woman at the front desk told him there was no accident reported that day. The woman directed
the complainant to contact 311 with his SR number, so he did. The 311 dispatcher said that it was
noted that an officer spoke to the complainant on November 6th at 10:21 am. The complainant
stated he never spoke to an officer. He checked his call log and confirmed he never received a call
from APD. He wants to know why that officer lied and said he spoke with him, and why his case
was closed with no accident report made.

Good morning,
I would like to inform the OPO and APD about the actions of one of your officers. Let me start by
saying that, I do not know what the officer's name or badge number is, or patrol vehicle because I
was not pulled over. But I would have been if I had not turned into the gate at my job, which
would have been an unlawful stop. Between the times of 4:30am - 4:45am this morning, I was on
Tillary street in East Austin going to work. I saw a APD patrol vehicle at a stop sign that almost
pull out in front of me, but he backed up. As I passed by, he turned and started to follow me, I
know this because of what happened next. On Tillary there is a back gate to get to my job, and as I
turned in to my job to badge in, the patrol vehicle stopped at the entrance as I was badging in the
gate. He waited until the gate started opening to leave. I cannot tell you how frustrating that made
me feel. I did not break any traffic violations, laws, or involved in anything criminal so what is the
reason for following me. This is one of the many reasons the community and APD have a bad
relationship with each other. Where is the trust? A guy is just trying to go to work with potentially
getting harassed by APD, great way to start the work day right?
I understand that the new Chief has a 100 day plan which includes community trust and to quote
one of her statements "I must take time to listen to your experiences and concerns". Well, this is a
concern that definitely needs to be listened to. I try to support the APD and I have friends that
have worked on the force but situation like this hurts APD more than you know. So, I hope this
message finds it's way to the Chief and definitely I am willing to have a conversation about this
situation. I sure hope that you can speak with the officer as well. Like I said, I was not pulled over
but APD does have GPS on the vehicles and maybe you can find out who was patrolling Tillary at
the times that I gave and speak to them. I will end this by saying this. Me or anyone else should be
able to go to work no matter what time it is without the potential of getting harassed and I really
hope APD does better by the community.

I called on Wednesday, November 20th at 12:54 am for a noise complaint at the golf course
facilities right outside my house. The dispatcher said they would send an officer out to check. I
called back 18 minutes later at 1:12 am to ask the update on the situation. The dispatcher replied
that an officer went out and didn't find anything. This is untrue because at noon on the very same
day, I went to the golf course to inquire about the situation and the general manager confirmed
my suspicions that there was someone cleaning the septic tanks around 1 am. Either the
dispatcher was dishonest or did not do their job to check out the situation. It was very obvious
that someone was there making a lot of loud noise during supposed quiet hours. I am extremely
hurt and distrustful of the Austin Police Department after this incident.

Incident Report: Hit and Run Involving Injuries and Delayed Police Response
Date and Time of Incident:
November 22, 2024, at approximately 6:00 AM
Location:
Intersection of 620 and Parmer Lane
Incident Summary:
On November 22, 2024, at approximately 6:00 AM, my brother was the victim of a hit and run
collision at the intersection of 620 and Parmer Lane. Following the collision, a call was placed to
9-1-1 to report the incident and injuries sustained. However, the dispatcher failed to dispatch the
Austin Police Department (APD) to the scene, sending only fire and EMS services.
Injuries and Medical Response:
My brother sustained significant injuries, including a broken arm, fractured wrist, and broken
finger. Due to insurance concerns, he declined EMS transport, and I transported him to the
hospital for treatment.

Vehicle Condition and Towing:
The vehicle involved in the collision was inoperable and totaled. It was towed from the scene by
Stars Towing.
Issues with Reporting Process:
After my brother was discharged from the hospital, I attempted to report the incident to law
enforcement. The following sequence of events outlines the numerous failures and delays
experienced:

Upon contacting the Wilco Sheriff's Office, we were informed that the incident should be handled
by the Austin Police Department (APD).
Transfer to 9-1-1:
We were transferred back to 9-1-1, where we were informed that the dispatcher notes incorrectly
reported "no injuries." We were provided with the EMS/Fire report number (243270322) and
instructed to call Austin 3-1-1.
Attempts with Austin 3-1-1:
After contacting Austin 3-1-1, the operator directed us to submit the report online through the I-
Report system. Despite making four attempts, the system repeatedly failed to process the report
due to the inclusion of injuries and a towed vehicle. The 3-1-1 operator refused to assist in
contacting an officer, despite being informed of the system's failure.
Visit to APD North Station:
Frustrated by the lack of progress, I drove to the APD North Station. A city employee on site was
finally able to assist by contacting dispatch and having an officer sent to meet me.
Resolution:
The officer who arrived filed the incident report, with the assigned report number being 24-
3270910.
Delays and Demands:
The accident occurred at 6:00 AM, and the incident report was not filed until 2:40 PM. This 8-
hour delay, caused by dispatcher errors, miscommunication between agencies, and failures of the
I-Report and 3-1-1 systems, severely hindered the timely investigation of this serious hit and run.
The negligence displayed throughout this process is unacceptable and warrants immediate
attention. I demand a full review of the failures in this case and prompt updates on the progress
of the investigation. Any further mishandling of this matter could compromise the investigation
and erode trust in the department's ability to protect and serve.
We reserve the right to pursue additional actions if these issues remain unresolved or if the
delayed response impacts the outcome of this case.

Between Nov - Dec 2019, I formally reported child sex abuse crimes to APD. The initial officer I
met in the APD building took my case seriously and referred my report details to the Sex Crimes
unit. I was then assigned a female detective who would interview my in a video recorded setting
at the sex crimes unit building. This female detective (I am currently asking for her badge info,
full name, and a copy of the report from the Public Records division), stated in our video recorded
interview that "it's not illegal in the State of Texas to sexually groom children. It's not illegal to
have a creepy uncle. We all have them". When I challenged that, as this is not true even from a
federal level, her response was "well, in TX it's not" and then closed the case.

guardianship, from Bedicheck Middle School to question him regarding an investigation into a
fight. The complainant states that he was not notified by the officer of the questioning nor did the
officer attempt to obtain consent to speak to a minor. After the questioning, the nephew was
reportedly forced to walk home as he was unable to contact his guardian to inform him of his
location. The complainant asserts that the officer's actions were improper, and that parental or
guardian permission should have been obtained prior to questioning.

Dear Chief Lisa Davis,
I came across this video which includes a clip of an interaction with an Austin Police Officer
which I believe need to be scrutinized. See time stamp 8:19.
I'm not sure of the date of this interaction but felt compelled to follow up to ensure the safety and
rights of all citizens are protected from officers who abuse their authority. Particular attention for
officers needs to be the 1st 4th and 5th amendments of the US Constitution.
The officers behavior did not bring good credit to your department and shows a disrespect to
those they swore an oath to protect their constitutional rights. This officer is seething ego. A
person with a badge and a gun with that kind of ego is a very dangerous combination. This is but
one officer and one encounter with that officer. The problem is thousands of citizens have now
seen this video and it makes every officer look bad. The question then becomes, is the problem
systemic. Does the culture and attitude of your department align with your core values and
mission?
It amazes me that Departments have yet to become aware that citizens are becoming more aware
of their rights and filming police interactions is a very common trend that continues to grow. I
believe this is a training opportunity. Unfortunately, an ego is a very difficult thing to train.
