"Collision investigated by APD. Chief investigating officer Ryan West made only assumptions
leading to gross misconceptions and inaccuracies in the investigation. Attached is the listing of
the misconceptions/inaccuracies made by Officer West and his Assisting Officer Robert Kaiser,
with supporting statements regarding the misconceptions/inaccuracies. Also included with this
complaint is a copy of a Petition for an Order of Expunction regarding the citation that was issued
by Officer West, #E17435491. All supporting documentation presented with the Petition is the
same information that will support this complaint. The Austin Municipal Court dismissed the
case on July 3, 2023 because neither the other driver nor either of the officers chose to appear. As
a result I was unable to present any of my supporting evidence that the subsequent traffic
collision and citation issuance were incorrectly perceived and inaccurate on behalf of both
officers and the other driver.

"I was involved in an accident where someone ran a red light. I called APD and several officers
showed up. There was concern that the person who hit my vehicle might have been under the
influence therefore a field sobriety test was completed. I never got to speak to the person who hit
me, as he did not speak English, and we were never able to exchange information as the police
kept us separate. I received "accident information exchange" paperwork with the person's name
on it and was told an official report would be filed.
I was under the impression that an accident report would be filed as this is what I was told. I
ASSUMED WRONG. There were at least 4 officers at the scene, one was in training, and none of
them filled out or filed a police report. The time period I had to wait, due to an officer in training,
and needing to wait for a Spanish speaking officer, then only to find out that no one did their job
is ridiculous.
Due to office J. Garcia APD #9626 not filing a police report, my insurance carrier cannot
determine fault (which was obvious as the person who hit me ran a red light. So NOW I will not
be reimbursed for money that was paid out of pocket to fix my vehicle because Officer Garcia did
not fulfill his job requirements and fill out a police report.
I FIND THIS TO BE so UNACCEPTABLE ON THE PART OF THE POLICE DEPARTMENT. Why would
I call someone if they are not going to do there job correctly. This sort of behavior would not be
accepted at my job, not sure why it should be acceptable with a Police Department. I could have
eventually gotten the information from the person on my own had I known that APD would do
such a terrible job at the scene of the accident."

"APD Officer Yaletchko #8132 brought an adolescent male mental health patient with an
intellectual disability to Dell Children's Medical Center ER today on POED #232160528. Officer
Yaletchko #8132 did not include the name or contact number for patient's guardian on POED
form. I called APD dispatch and was connected to APD Officer Acosta #7754 who was very helpful
and provided the name of the facility patient came from and the name and contact number for
patient's mother. I then spoke with Officer Yaletchko #8132 who stated he was efficient in telling
a nurse the guardian information, however did not document this on patient's POED. I
recommended guardian/caregiver/facility information always be included on POED in the future
and he did not seem receptive to my recommendation. I questioned patient's initial nurse,
who stated Officer Yaletchko #8132 told her someone from a grouphome was on the way. I then
questioned patient's current nurse,
(patient quickly changed ER rooms after arrival), who
stated she was not given guardian information as well. The patient's ER Social Worker called
patient's mother with the contact information provided, and her number is not in service. Neither
mother nor grouphome employee came to the ER."

"I am a Taiwanese international student who recently graduated from the University of Texas at
Austin.
The Incident happend on August 5th, around 11:30 pm, in front of Wonder Bar in the Domain
area, my friends and I had just gotten out of an Uber.
A cop came up to me and asked, "Sir, what is in your hand?"
I realized I was holding a seltzer and gave the drink to him, saying, "My bad, I'm sorry."
Lieutenant(the cop): "I'll have to throw this away."
Me: "Yeah, of course, my bad."
My friends and I went into Wonder Bar.
A bouncer approached me and said, "Hey, I just want to let you know, we work closely with the
police, and an officer said you were giving him an attitude." (Insinuating the police can have me
kicked out of the bar just because he doesn't like me)
Me: "Um, what? And what did I do?"
Bouncer: "That's what he told me, and just say you are sorry."
So I went out, found the officer (Lieutenant) who took my drink.
Me: "Hi, officer, I'm sorry, what happened?" Lieutenant: "I did not see anything." Me: "What's
going on?"
Officer Willis: "You gave him an attitude, you did the gesture, it was insulting."
Me: "What gesture, and no, I did not do anything."
Officer Willis: "So you are lying to me now?"
Me: "I did not do such a thing."
Officer Willis: "Why don't you own up and have some integrity? Stop lying. You wait till the
Lieutenant turns and did the gesture." I felt scared and pressured to apologize.
Me: "Sorry, officer, maybe I did some gestures, but it wasn't towards you guys."
Officer Willis: "Ok."
He escorted me back to the bar.

Back inside the bar, the more I thought about it, the more uncomfortable I felt for what had just
happened. It's bad enough for being misunderstood, and it's worse for being called a liar, a
coward, and a man with no integrity; it's the worst when someone calling you all that has
weapons ready to use on you. I felt powerless. I'm living in a foreign country on my own, and it's
scary for what could happen to me if they decided to abuse their power fully. I decided to get their
name and number without aggravating anything. So I went out to talk to Officer Willis.
Me: "Hello, officer, I'm not from here, this is my first time interacting with a police officer, can I
take a picture?"
We took a picture. [attached to complaint form -FC]
My friends and I went back into the bar. After some contemplating and typing what happened and
how I felt on my phone, I decided to go out again to find Officer Willis.
Me: "Hey, you called me a man with no integrity." Officer Willis: "That bothers you?"
Me: "Yes, it does."
Officer Willis: "People get mad when someone questions their integrity."
Me: "I just need an apology."
Officer Willis: "Apology from whom?"
Me: "You."
Officer Willis: "No, I'm just doing my job."
Me: "You called me a man without f***ing integrity."
Officer Willis: "Back your ass off, we are not on the same level, I can take your ass to wherever I
want. You are a coward who waits till Lieutenant turns his back on you and did the insulting
gesture. You understand me?"
I turned to another officer and said, "Do you agree with what he just said?"
Random officer: "We don't care what you think." Me: "Lieutenant, hi, you did not see me doing
anything, right? You agree with what Officer Willis just said?"
Lieutenant: "I agree with him 100 percent."
I left in frustration, anger, and disbelief. In frustration because I have no power in this country; in
anger because I was called a liar and a coward; in disbelief because he said he has the power to
"take you wherever I want."

them they could not question her and that she needed to talk to her attorney. The
officer's behavior was very harassing and targeted. They asked for her ID, but they did
not run a check on her ID because there is a missing person's report that was filed by her
husband. Officer Williams and Officer Wright picked her up, so she started screaming
because she is autistic and very preceptive to danger. Her emotional support dog, who is
like her child, ran away. She was screaming her head off because they were about to
murder her. Some neighbors caught the incident on video. The officers put her face
down on the ground. They pulled her arm back, which is called a broken wing hit, so it
was an assassination attempt. The officers laughed about squeezing the shit out of her
because she actually defalcated on her shelf. The officers went thru her purse which was
very unprofessional. They took her purse to another spot across the street, so they
actually stole her purse. The complainant alleges the officers took their sweet ass time to
hurt her arm even more. They arrested her and put her arms behind her back and would
not uncuff her while the EMT was checking her. It was like they were Nazis and called
her the dirty Jew, so it was very targeted and a hate crime. They took her to the hospital

"On Wednesday, August 9, 2023, at approximately 1500 hrs. I was traveling northbound on I-35
frontage road. A blue Ford Explorer unmarked vehicle entered the frontage road within 100 ft in
front of me while traveling at speeds of close to 50 mph causing myself and the vehicle behind me
to slam on brakes and 3rd vehicle to swerve into the left lane as to not rear end the vehicle in
front of it. The occupant of the vehicle, white male, black shirt sped off after I nearly hit his
vehicle. The blue unmarked car came out of the carwash at the corner of Philonoma and Frontage
and sped North to Brent Road. I assumed he was on a call and was forgiving of the incident.
Shortly after I arrived at the IDEA Kyle school waiting to pick up my children when I saw the Blue
unmarked Ford Explorer in the outside lane 2 to 3 cars behind me. I waited until I was able to
park safely and waved down the officer driving the Blue unmarked vehicle. He stopped, rolled his
window down, and I noticed he was not on duty. He had no duty belt, no badge, no uniform. I
asked him if he had a card, he said he did not. I asked him if he could write his name, badge
number, and the number of the unit he was driving as I needed the information to file a
complaint. I began to explain to him the incident to which he told me "that did not happen" I
explained to him not only when but where the incident occurred and also his path of travel after
he sped away. He handed me a card and asked for my information, at the moment, after what had
occurred, his nonchalant demeanor, and noticing he was not dressed in a uniform, I declined to
identify for fear of retaliation against myself or my children, The card he provided indicated he
was the rank of Lieutenant and his name is Christopher Juusola. I am not asking for extreme
consequences, I just want accountability for his behavior and actions of recklessness driving
putting myself, my autistic son, and other occupied vehicles with citizens at risk. His
professionalism was very unbecoming of the standard that i"m sure you hold your officers to on
and off duty. I was in no way aggressive with him and was wanting to just simply get his
information to file a simple complaint.

"She is 57 years old and a law-abiding citizen and has never been afraid of a police officer before
this incident. The officer was so over the top and angry and she was very fearful. She almost
started recording but she was worried it would further provoke the officer. She was sitting in
traffic at a light on 183 southbound. As she started moving forward there was a motorcycle
officer turning onto 183. She was going 60mph when the officer got in front of her and slowed
down so she changed lanes. She was talking to someone on the blue tooth when she saw the
officer waving his right arm up and down and yelling at her. The officer motioned for her to roll
down her window. When she rolled down her window the officer screamed at her "Really, you
are going to pass me in a construction zone?" They are literally driving 60mph next to each other.
She told him she was not speeding. When the light in front of them turned red the officer
motioned to her where to stop. He kept screaming at her. He was an African American male, and
his last name was MacDonald or McDonald. She continued to tell him she was not speeding. The
officer was so out of control and still screaming at her. Out of frustration, she said, "Dude I am not
speeding". The officer told her "Yes you are I could pull you over and give you a ticket right now".
He told her "This is a newly calibrated bike, and you are speeding". The person on her blue tooth
could hear the officer yelling at her. She changed lanes trying to get away from him. She has
never been afraid of a police officer until that happened. She has had one ticket in her entire life.
As she drove away, she could tell he was still looking at her. Her honest thought was that she felt
sorrow for anyone who interacts with that officer because he is going to lose it. If she was really
doing something wrong, just pull her over and don't scream at her. The officer's behavior was so
uncalled for, and she thinks it needs to be brought to his attention that it was not ok. The
complainant requested the complaint be sent to an APD supervisor for a callback."

I am

had a harrowing experience with an Austin Police Officer.
I was at a Sonic Drive-Thru pulling forward to exit the restaurant. A white Ford F-250
truck was in the path to exit the Sonic. I lightly tapped my horn, for the truck to pull
forward. The truck did not pull forward, so I maneuvered around him. Once I was around
the truck, I gave him an unkind gesture (flipped him off). Turns out he was a very tall
large man, Mark Lakes (off duty police officer) with his
in the truck - but I
cannot tell any of this initially.
After flipping him off, I pulled away from Sonic. Shortly from pulling away, I see that
same white truck driving very close behind me. I stop at the stop sign, and while turning
to take a right; the truck speeds up in front of me and cuts me off from the highway at a
45 degree angle with his truck. I am appalled and baffled, by this driver's actions. Then
suddenly a very large angry man, not using his words comes out of the vehicle. I
immediately start reversing my car. As I am reversing, the man punches my front driver
side window, and hits my rear driver side window with his forearm. Frantically, I dial
911 and proceed to evade the man by turning onto the nearby street. I told 911 "I had
flipped off a guy and he is chasing me". The truck shoots onto the highway to cut me off
again at a 45 degree angle at the following stop sign. He chased me cutting me off on
three occasions, and I was able to reverse and try to evade him until the 3rd time. When
he blocked me the 3rd time he came up to car yelling "you hit my car and my kid is in
there". Slammed a business card with his name Mark Lakes APD, on my windshield. I had
the doors locked but when my car went into park, it unlocked and he pulled open my
driver side door and lunged into my vehicle. I scrambled to the passenger side evading
my SUV, and as he enters my car he crushes the interior of the door handle with his arm.
He scared me silly; to the point where I thought I was going to be physically harmed or
kidnapped. Police arrived in response to my long hysterical 911 call. I found out from
responding officers that he is indeed an Austin off duty police officer. Stating that: I hit

"His cousin received a speeding ticket in Oklahoma. The ticket was not readable, so he went to

"Hi, I called police to my old residence many times because I was being stalked by neighbors
nearby. APD sent over a dozen cops to their door but they never opened it. I reported it in every
way that I could to receive no help at all whatsoever. I asked the apartment management for help
and instead of in any way understanding that "the absence of evidence when no policework is
being done past knocking on the door, is never the evidence of absense" they made up a lie that I
was crazy on my birthday. They asked the police to go to my door on my birthday and accuse me
of insanity and they obliged, thereby creating a malicious lie about me throughout the community
as many of my neighbors heard this in the public corridor. This includes the stalkers who very
much enjoyed committing a hate crime against me as they were never even once intercepted to
be reprimanded. I am extremely ashamed because the police ridiculed me as well as the stalkers.
They enabled everyone to harass and stalk me in my home and didn't seem to do any police work
to attempt to locate them other than knock on their door and take that as "good enough." It
should be illegal for police to be messengers for malicious lies in the community and I hope that
will never happen again to anyone. The only reason that it doesn't qualify as a hate crime, is that I
don't have the electronic correspondence. The apartment manager told me they made up a lie
about me over the phone. The police spread the lie and that should never happen again. The
stalkers were never intercepted and are probably currently stalking someone in an attempt to
commit a hate crime because no one ever stopped them. I hope that you will reform the police so
that they never accuse a queer person of insanity on their birthday ever again. I had a legal name
change but I will never trust them again or open the door for them at all, since they seem to side
with whichever party doesn't open the door for them. I am extremely ashamed of APD and a few
months ago I was meeting with the hate crime coordinator for coffee but now I don't know if I
will even reply to him... I don't see how in any way harassing me further was good practice to
investigate stalking. I didn't see any investigation happen at all, other than attacking my character

"I am a
international student who recently graduated from the University of Texas at
Austin.
The Incident happend on August 5th, around 11:30 pm, in front of Wonder Bar in the Domain
area, my friends and I had just gotten out of an Uber.
A cop came up to me and asked, "Sir, what is in your hand?"
I realized I was holding a seltzer and gave the drink to him, saying, "My bad, I'm sorry."
Lieutenant(the cop): "I'll have to throw this away."
Me: "Yeah, of course, my bad."
My friends and I went into Wonder Bar.
A bouncer approached me and said, "Hey, I just want to let you know, we work closely with the
police, and an officer said you were giving him an attitude." (Insinuating the police can have me
kicked out of the bar just because he doesn't like me)
Me: "Um, what? And what did I do?"
Bouncer: "That's what he told me, and just say you are sorry."
So I went out, found the officer (Lieutenant) who took my drink.
Me: "Hi, officer, I'm sorry, what happened?" Lieutenant: "I did not 839 see anything." Me: "What's
going on?"
Officer Willis: "You gave him an attitude, you did the gesture, it was insulting."
Me: "What gesture, and no, I did not do anything."
Officer Willis: "So you are lying to me now?"
Me: "I did not do such a thing."
Officer Willis: "Why don't you own up and have some integrity? Stop lying. You wait till the
Lieutenant turns and did the gesture." I felt scared and pressured to apologize.
Me: "Sorry, officer, maybe I did some gestures, but it wasn't towards you guys."

He escorted me back to the bar.

Back inside the bar, the more I thought about it, the more uncomfortable I felt for what had just
happened. It's bad enough for being misunderstood, and it's worse for being called a liar, a
coward, and a man with no integrity; it's the worst when someone calling you all that has
weapons ready to use on you. I felt powerless. I'm living in a foreign country on my own, and it's
scary for what could happen to me if they decided to abuse their power fully. I decided to get their
name and number without aggravating anything. So I went out to talk to Officer Willis.
Me: "Hello, officer, I'm not from here, this is my first time interacting with a police officer, can I
take a picture?"

how I felt on my phone, I decided to go out again to find Officer Willis.

I turned to another officer and said, "Do you agree with what he just said?"
Random officer: "We don't care what you think." Me: "Lieutenant, hi, you did not see me doing
anything, right? You agree with what Officer Willis just said?"
Lieutenant: "I agree with him 100 percent."
I left in frustration, anger, and disbelief. In frustration because I have no power in this country; in
anger because I was called a liar and a coward; in disbelief because he said he has the power to
"take you wherever I want."

"She walked across the street to her neighbors and APD started to integrate her. She told
them they could not question her and that she needed to talk to her attorney. The
officer's behavior was very harassing and targeted. They asked for her ID, but they did

husband. Officer Williams and Officer Wright picked her up, so she started screaming

like her child, ran away. She was screaming her head off because they were about to
murder her. Some neighbors caught the incident on video. The officers put her face
down on the ground. They pulled her arm back, which is called a broken wing hit, so it
was an assassination attempt. The officers laughed about squeezing the shit out of her
because she actually defalcated on her shelf. The officers went thru her purse which was
very unprofessional. They took her purse to another spot across the street, so they
actually stole her purse. The complainant alleges the officers took their sweet ass time to
hurt her arm even more. They arrested her and put her arms behind her back and would
not uncuff her while the EMT was checking her. It was like they were Nazis and called
her the dirty Jew, so it was very targeted and a hate crime. They took her to the hospital
and Officer Wright, the one that broke her arm, was the only one that followed. Officer
Wright sat in the room with her and kept watching the video of her screaming and you
could actually hear her arm crack. She asked the nurses not to leave her in the room with
Officer Wright because he was trying to kill her. She had to go to the bathroom and
Officer Wright told her she had to leave the door cracked or a nurse would have to go
with her. The complainant pulled her pants down and realized she had defecated on
herself, that's how bad the police brutality was. She took her pants off and laid them on
the trash can and kept wiping herself with wipes and laying them on the trash can
because it was evidence. She told the officers it was evidence, but they did not take it
with them. They were supposed to take her back two or four days later get a cast on her
arm, but they did not. Her arm is crooked from the break. They took her straight to
prison and never read her Miranda rights. They gave her a PR bond the first night. They
kept changing the information about her arrest in the system. The first seven days they
did not let her outside and after the 8th day, they let her take a shower, which was a cruel
and unusual punishment which was turned into slavery. She was really confused. She is

"The complainant is experiencing ongoing harassment from Officer Michael Ganther. On
different occasions the officer has issued citations for camping when he is not camping,
noise violations, and has threatened to tow his vehicle. The complainant gave an incident
report number 230-2410644
The complainant mailed a handwritten complaint form with additional information. The
complaint form states, "Officer Kevin Garvey AP 6445 badge number is harassing me. I
believe it is racial or cultural profiling since I am not breaking any laws. I fear retaliation
from him or others."
The complaint lists 7 points detailing the complainant's concerns and interactions with

1. "Garvey has made it clear that he is targeting me"
2. "On 6/12/2023 he gave me a ticket for 'audible noise' when my music was not
violating anything."
3. "On 6/29 he gave me a camping in public ticket at 11:30am..."
4. Complainant alleges a "baggie of white powder" was planted in his son's Jeep
5. "...verbally harassed me."
6."Yesterday he attempted to tow my son's truck without good cause"
7. "I found a police report by Michael Ganther that lied about me. When my witness called
and texted officer Garvey to give truthful evidence he ignored her. Failure to
investigate"
