The complainant alleges: On
Detective
went over to the

And bullied and intimidated my brother who is a federal inmate on furlough at this
location, at the request of his case manager

stated to my
brother if he fails to register as SO he will go to the prosecutor and have him arrested. Detective
arrived at the halfway house with another officer unidentified, we believe this was totally
inappropriate for APD
to be threatening and demanding that my brother register as as
sex offender at that particular time my brother has was not out of any compliance he had just
arrived at the halfway house on
The issue started with his case manager because
my brother and I believe that he should not be registering until he left the halfway house, because
he is still considered a federal bureau of prison inmate. My brother does not have an issue with
registering nor do I we just felt like this should be happening once he leaves the halfway
house,being that we live in Travis County and not Austin City limits. I reached out to Sergeant
to see if she could give me further clarification on this, she was unable to clarify
SO she had me to speak to detective
and which he was very rude to me and said he was
not going to be my researcher and gather information for me to have an understanding of this, he
also stated to me that if my brother doesn't register he's going to the prosecutor and have him
arrested. I believe this is very inappropriate for a detective to speak to the people he's supposed to
serve in this manner I was only trying to gain an understanding and clear information. The case
manager
should have never involved detective
she should have
contacted the federal probation office. If there was a problem. She should have also tried to de-
escalate situations when in fact she escalated by involving detective
My brother had not
committed any criminal offenses SO it was no reason for detective
to be going out there
and giving his phone number to my brother on a sticky note pad and threatening him in harsh
words that he would have him arrested and also having this discussion in the presence of other
inmates at this halfway house where they can hear my brother's private personal business. Other
inmates could attack my brother because of this conversation that was overheard putting my
brother's life in danger. Since
I have repeatedly received calls from policeman's
people from the county traffic and bridge department people calling my number asking if I am a

wrecker truck company? late at night. Just on today
I received a call from gentleman with
Travis County road and bridge asking to speak with
with TxDOT, the gentleman
told me he was dialing
All of these calls are being routed to my personal cell
number, I have had my personal cell phone number for over 12 years and I'm just really baffled
as how my number got involved with law enforcement in this manner? I believe that detective
may have something to do with this being that TxDOT has oversight over the sex
offender registration unit. I have a current ongoing complaint and investigation into this with 311,
the reference number for that complaint is #
His case manager
should have
took him into her office and explain to my brother why she believed he should be registering at
that particular time and not be calling APD on him, as if he had violated the law. And detective
should have told her that he is not going to get involved it's nothing to be calling him
about and if he fails to register at that time he can do something about it. My brother's intent was
never not to register we just believe that he was supposed to do that once he left the halfway house
with the Travis County sheriff's office where we live. My brother is not on any current probation
nor parole with the State of Texas. He is a federal prisoner on furlough SO if anything the US
Marshals have oversight over him.. and I repeat he hadn't broken any law at that particular time
and he has since then scheduled an appointment to register with APD, and we would also like to
understand that process because when he's scheduled the person setting the appointment told him
it was going to take 2 hours. We don't understand why giving your name and filling out paperwork
and taking a picture. Would take 2 hours SO now it seems like something out of the ordinary is
going to be happening to him at this appointment scheduled for
we would
also appreciate more clarification on this registry when you are a federal inmate on furlough? we
would also like more information on when you go to register how that process is supposed to
actually take place and what information is being required at this appointment? And we would like
the actions of detective
to be addressed. Also on
detective
signed out that he was going to lunch when he actually went out to the halfway house and his
Superior
can verify that.
This notice of complaint is a request for Internal Affairs to initiate an investigation to determine
if the employee conduct is within compliance of APD policy, Civil Service Rules, and Municipal
Civil Service Rules.
