On January 30, 2023, the OPO received a phone complaint.
The complainant alleges: His oldest granddaughter left home to go to her grandmother's
house. While she was gone a Hispanic guy dislodged the apartment's sliding glass door
and got into the house while his daughter and younger granddaughter were asleep. The
younger granddaughter said she woke up to a Hispanic guy standing over her yelling
"where is he at-I am looking for him --- where is he at I am after him". The granddaughter
fought him out of the bedroom and down the stairs into the living room. As the Hispanic
guy was leaving, he made the comment, "I am coming back to get y'all." He did come
back but with a gun. It was like something clicked in his mind, SO he left. His
granddaughter's mother told the complainant about the incident that happened. The
complainant called the
office first but did not get a response. He called again the
next day, and the call was diverted to 311. 311 took his report. The Hispanic guy had been
going around the neighborhood threatening people. 911 was called and APD never
responded. The Hispanic guy sent words to his daughter and granddaughter apologizing
and saying he was wrong and out of his head. The complainant is well-known in the Austin
Police Department. He was a self-made neighborhood watch years ago in South Austin.
He became accepted by APD and

who was with APD at the time, would invite
him to the police meetings.
This notice of complaint is a request for Internal Affairs to initiate an investigation to
determine if the employee conduct is within compliance of APD policy, Civil Service
Rules, and Municipal Civil Service Rules.
