Good afternoon, Chief Henderson:
This complaint was internal and generated local media interest when a road rage video went viral.
The Office of Police Oversight (OPO) monitored the investigation conducted by the Internal
Affairs division of the Austin Police Department (APD). Officer Hattaway is scheduled for a
disciplinary meeting with his chain of command tomorrow, January 11 at 2 pm. The 180 for this
case is 02/26/2024.
Officer History
Officer Hattaway has no sustained complaints of a similar nature. However, Officer Hattaway was
the subject officer of two other complaints that alleged identical behavior to this complaint. One
complaint is from 2023 and was closed as inconclusive. The other complaint was from 2021 and
was also closed as inconclusive.
It
is the opinion of the OPO that Officer Hattaway has a pattern of engaging with the public that
does not reflect the values of the APD.
Disposition by Chain of Command
OPO concurs with the sustained finding for APD policy 900.3.2, Acts Bringing Discredit.
Discipline Recommendation
Upon review of the Notice of Sustained Allegations (NOSA), OPO notes that Officer Hattaway's
chain of command is considering up to and including a 15-day suspension as well as education-
based discipline as an option.
The OPO recommends that Officer Hattaway not be permitted to employ education-based
discipline for this APD policy violation.
The OPO recommends that the Officer receive a suspension of 5-10 days off for violating
APD policy and bringing discredit to APD.
