Notice of Finding of No Significant Impact and Notice of Intent To Request Release of Funds - 8301 Riverstone

REQUEST FOR RELEASE OF FUNDS

On or about August 11, 2026, the City of Austin will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnerships Program (HOME)  funds under Title II of the Cranston-Gonzalez National Affordable Housing Act of 1990, as amended, to undertake a project known as 8301 Riverstone, for the purpose of new construction, located at 8301 Riverstone Dr, Austin TX 78724. 8301 Riverstone is a three-unit ownership development, developed by 8301 Riverstone LP (the general partner being ARA Riverstone LLC and the limited partner being Equidad ATX), in an older established section of the Colony Park neighborhood in Northeast Austin, TX. The project will serve households up to 80% MFI with an average bedroom size of 1300 square feet. The project will utilize $720,000 in HOME Community Housing Development Organization (CHDO) funds through the City of Austin and the total project cost, including acquisition and construction, is $1,740,477. Due to this project involving new construction, radon testing must be performed post construction, and the Environmental Review Record will be updated with relevant findings.

FINDING OF NO SIGNIFICANT IMPACT

The City of Austin Housing Department has determined that the project will have no significant impact on the human environment.  Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required.  Additional project information is contained in the Environmental Review Record (ERR) on file at The Austin Housing Department, located at 1000 East 11th Street, Suite 200, Austin, TX 78702, where ERR can be examined or copied weekdays 9 A.M to 4 P.M. ERR may also be requested via email by contacting dawn.perkins@austintexas.gov.

PUBLIC COMMENTS

Any individual, group, or agency may submit written comments on the ERR to The Austin Housing Department at 1000 East 11^th Street, Suite 200, Austin, TX, 78702, via email by contacting dawn.perkins@austintexas.gov, or via phone by calling 512-974-3100.  All comments received by August 10, 2026 will be considered by the Austin Housing prior to authorizing submission of a request for release of funds.  Comments should specify which Notice they are addressing.

ENVIRONMENTAL CERTIFICATION

The Austin Housing certifies to HUD that Deletta Dean in her capacity as Director consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied.  HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows The City of Austin to use Program funds.

OBJECTIONS TO RELEASE OF FUNDS

HUD will accept objections to its release of fund and The City of Austin’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of The City of Austin (b) the City of Austin has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.  Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at the San Antonio Field Office at CPDRROFSAN@hud.gov.  Potential objectors should contact HUD to verify the actual last day of the objection period.
