OPO Recommendation for Case # 2024-0659, Officer Phillip Sparkman

In response to Chief of Police Lisa Davis's disciplinary determination regarding Officer Phillip Sparkman's conduct, the Office of Police Oversight recommends that he receive an indefinite suspension in accordance with the Discipline Matrix.

After reviewing the investigation findings, OPO concurs that Officer Sparkman violated the following APD General Orders: 900.3.2 (a) Acts Bringing Discredit Upon the Department, 364.3 (d) Firearms, 900.1.1 Responsibility to Know and Comply-to wit: DWI, 900.1.1 Responsibility to Know and Comply-to wit: UCW, 900.3.1 Honesty, and 902.4.1 (b) Cooperating with Assigned Investigators.

This complaint was generated by Officer Sparkman's chain of command on June 25, 2024, related to the
officer's arrest by the Round Rock Police Department on June 22, 2024, for Driving While Intoxicated
(DWI) and Unlawful Carrying of a Weapon (UCW). Austin Police Department's (APD) Internal Affairs
Division (IAD) initiated an investigation on Officer Phillip Sparkman, AP7795, for violating their General
Order's Firearms, Responsibility to Know and Comply, Acts Bringing Discredit Upon the Department and
Cooperating with Assigned Investigators. The Office of Police Oversight participated in the investigation
and provided oversight.
Officer Sparkman is scheduled for a dismissal review hearing with you and his chain of command on
December 13, 2024.
Disposition by APD Chain of Command
Upon review of the Notice of Sustained Allegations (NOSA), OPO concurs with the sustained findings for
the following APD General Orders:
900.3.2 (a) Acts Bringing Discredit Upon the Department
364.3 (d) Firearms
900.1.1 Responsibility to Know and Comply-to wit: DWI
