2024-0812 Discipline Recommendation
Dear Chief Davis:
On August 12, 2024, the Office of Police Oversight (OPO) received an external citizen's
complaint, 2024-0812, alleging an Austin Police Department (APD) officer had been discourteous
in his actions while interacting with a potential victim and did not investigate an outcry of domestic
assault. The complaint named Officer Todd Gilbertson, AP7066, as the officer interacting with the
potential victim.
On 08/19/2024, OPO forwarded the complaint to the Internal Affairs Division (IAD) as a Notice
of Complaint due to the seriousness of the allegations. On 08/22/2024, APD Commander Shauna
Griffin, AP4670, requested that APD's IAD conduct an Administrative Investigation on Officer
Gilbertson's conduct and actions concerning the allegations.
Officer Gilbertson is scheduled for a dismissal review hearing with you and his chain of command
on January 27, 2025.
OPO Discipline Recommendation
During Officer Gilbertson's IAD interview, he admitted to violating General Orders 301.2, 301.3
and 401.2. It should be noted that Officer Gilbertson failed to address and document information
provided to him about a potential domestic assault that subsequently included a potential sexual
assault. These actions warrant concern, in that Officer Gilbertson failed to investigate a potential
penal code violation and he failed to follow investigative polices established by APD.
Considering the totality of the circumstances and in alignment with APD's General Orders
discipline matrix, The OPO recommends the complaint be Sustained, and Officer Gilbertson
receive an indefinite suspension in accordance with the Discipline Matrix.
