When a new private development project is constructed, the developer is required to provide sidewalks. However, when a project meets certain criteria, Chapter 25-6-354 of the Land Development Code allows developers to pay a fee in lieu of building sidewalks. When this occurs, the fees are set aside to fund future sidewalk construction consistent with the Sidewalk Plan. The fees are currently set at $7.50/square foot for residential; $18/square foot for multi-family; and $24/square foot for commercial.

Sidewalk Fee in Lieu funds are generally used on sidewalk and curb ramp improvements within the neighborhood from which the funds were collected. Funds must be spent within ten years, and any money not spent within this timeframe can be returned to the developer upon request.
