Thomas V. The City of Austin; Michael Vitale

Plaintiff Todd Thomas submitted this lawsuit against the City of Austin and Austin Police Department Officer Michael Vitale for the excessive force inflicted on him with a highly dangerous “less lethal” kinetic weapon. The plaintiffs requested compensatory and punitive damages. On April 13, 2026, parties filed a joint motion to dismiss as the case has been resolved by settlement of $3,000. On April 14, 2026, Judge Robert Pittman dismissed all claims in this case with prejudice by joint stipulation of dismissal.
